How would you handle the situation?

If it's illegal I wouldn't be handling anything. I'd leave that to the lawyers.

May, Have you been paying your portion, or has it been being deducted from your pay each pay period? If so, you may ask for the written notification from your employer stating coverage will be cancelled. Tell them, perhaps you missed it and want to have it available for future coverage to show you didn't have lapse in coverage and that your employer cancelled your insurance. This way you will have in proof in writing that they cancelled your insurance without your authorization. It's important to get that documentation. Then you can take it up with the labor board. Full-time employees are defined as individuals who work more than 30 hours a week. If you are enrolled in health insurance through your employer and it fits the definition of a large business, it cannot legally cancel your insurance, with or without notice.

An employee can voluntarily cancel coverage at any time only if the company is not having employee premium contributions deducted pre-tax.

First thing I would do is check my spam folder to see if a notification was sent by HR. That seems like an email conversation that would go out to everyone.

Hello May Delrosario, I'm sorry this has happened to you. Each state has different regulations for this kind of situation. I think you should consult with a lawyer and he is the one who can best inform you.

It's a illegal it shouldn't have happened. I would notify HR and tell them the situation and ask the proper way to resolve the issue. I would ask them for direct personal to handle the individual concerns. I would follow the advice that they gave me to handle the situation on my end if possible.
