Denied a Job After a Walmart Background Check? Your Rights Under the Fair Credit Reporting Act
Walmart outsources screening to companies like First Advantage and Sterling. These companies pull records from databases that are not always accurate. Wrong records, cleared convictions that still show up, offenses older than seven years that federal law does not allow to be reported, these are common enough that there is a federal law specifically built around fixing them. That law is the Fair Credit Reporting Act. Under it, Walmart must send you the report before the rejection is finalized. If that did not happen, the law was already broken. If you have the report, read it against your own history:
Does every record actually belong to you? Was anything expunged, meaning a court legally erased it? Does anything show an offense older than seven years?
If something is wrong, file a written dispute directly with the screening company. Name the specific record. Attach anything that proves the error: a court document, an expungement order, a government ID. They have 30 days to respond. Write to Walmart at the same time.
