Benefits

Can my employer fire me and deny New York unemployment benefits because my anxiety and stress has been very bad the past few months because I'm worried about getting sick with the corona-19 virus, even though i went to my doctor to get on medication. His reason for terminating me he sent in a letter stating that, “I was offered work on 4/27/2020. Failing to be ready, willing, and able to work without cause.” #unemployment #covid-19

Hi John, so sorry to hear about your recent work experience. New York is an “employment-at-will” state so an employer can terminate an employment relationship with you at any time and for any reason.

There are, however, law or agreements created to protect employees. You may find some protection under the CaresAct but you'll have to do some research to identify if your particular circumstances for separation of employment meet those standards.

Check the 'refuse to work' rules in the CaresAct to find out if you qualify. Good Luck! https://dol.ny.gov
