Discrimination termination

Does anyone know if there is a time period you have to be able to file a case for wrongful termination? I have a chronic illness and was covered under FMLA and was still fired from my previous job. I have wanted to contact a lawyer but they traumatized me so bad with the way they fired me that I have not had the courage to do so. Any Thoughts are appreciated. Thank you.

Can my friend be fired?

He went out on medical leave on Dec 4th had a Drs note, took FMLA from Dec 19-Mar 8. That is 11 weeks. He still has one more week to take FMLA. The Dr has suggested he stays out of work longer due to a medical mental disability. The problem is he is a government employee and cannot get disability. He is only protected by 12 weeks of FMLA. Can he be fired if tthe Dr takes him out longer than 12 weeks or puts him on a restricted schedule due to treatment appointments?

Wrongful Termination

Hi. I worked for a Glass company in Motaine Ohio. I was on approved FMLA. The day I was to return to work. I was terminated. Now I had never had any verbal written or any type of disclinary action. It took me by surprise that this happened. When I called to find out why they would not return my calls. It put me in a deep depression. I haven’t been able to find a job since October. I’m on unemployment but that barely covers bills. I have been in several interviews an I’m either over qualified or theybdontvtetun my calls. I actively search everyday. I have worked in the transportation /Logistics field for 18 years. I need to know if I have a case an if there is a lawyer out there that can help pro bono. Please help. In desperate need of work. Thank you.

FMla

so my job does a point system if you call off you get pointed if you late you get pointed....if you sick with a excuse you get point long story short its set up for failure cause they fall off a year from the time you got them. My son has a mental disability and I'm constantly going to appts or there is issues at school I'm on my last warning at my job I can't afford to loose my job so I want to file under FMLA to protect me I asked my employer for the paper work and they claimed they have to investigate to see if I put in enough time..mind you I been there a year and three months working 34.5 hrs a week I just went full time two months ago. Is my job on some be? should I start looking else where or try to claim FMLA?

Wrongfull termination

I was on disability and they terminated me. I was never notified by human resources my co worker called me and i was also on fmla. I filed complaints against my lead for harrassment. I requested a copy of my personal file. While on disability they requested a confetence call with two managers and a lawyer.

Is any of this legal?

I'm not sure what to do. Mid November I ripped a ligamemt, as soon as I left the emergency room at 4am I called my boss to inform him of my injury and that I could not work that morning and I had an excuse for 5 days for me to see a surgeon. At this time he decided to tell me its ok you're being demoted and moving locations anyways. Since I have been out of work I requested my 1 week vacation pay, upon recieving my weekly pay decreased $100. How is it possible to demote and decrease my pay when I haven't even seen my boss in person since before my injury? And if I earned that vacation at a certain rate shouldnt I recieve the rate in which I earned it? Also my most recent dr excuse states that at that time I was unable to return to work until December 26th after I completed physical therapy  and I should be re evaluated in 6 weeks. Even though my note says the 26th my boss will not let me return until after I am cleared again at my 6 week evaluation which is January 17th.

Can you draw unemployment after termination from a part time job?

I had worked for 4-1/2 years part time for a national company (in-home cust. support) when my daughter became very ill - in ICU for 5-1/2 wks and subsequently died . I was given no option for leave of absence and was fired with no notice.

Maternity Compensation Package

Does anyone know if I would be eligible to collect unemployment while out on Maternity Leave? The company gave me 12 weeks off without pay while on FMLA. I’m only going to get paid for my unused paid time off benefits like vacation and sick time which is not much so I’m looking for other options.

Something does not feel correct

My former employer let me go for attendance as they stated. I have been in and out of the hospital and doctors I have turned in the paper work as asked by them for my absences. They took my badge so I can't get into the building the same day they sent me home. I went to talk to HR that very same day but they were forcing all this paperwork on me telling me I had two choices I either file for medical leave of they are going to terminate me. When I went to pick up my check once again they were forcing the medical leave on me I let HR know I needed a letter of termination and they would not give it to me they also then insisted on me signing another paper stating that I voluntary resigned I did not sign the paper because I didn't volunteer to leave they made me leave and they also stated that even if they were not firing me today that they would in the future because I have a surgery in Feb that would cause me to miss work and that they would have to let me go even then I'm so stuck on what I should do I have 8 kids to take care of and I just feel as though they are wrongfully terminating me

Lost position

I was the assistant Manger of a well know Christian organization thrift store and donation center unto March of 2016. In march I found out I was in heart failure and in April under went open heart surgery to repair and replace some heart valves. I went on fmla but after 12 weeks they took my position away stating I would have a position when I was better. After researching I found out that I qualified for short term disability and due to this I was able to keep my insurance, however when I was ready to come back to work I was told that I would be paid only minium wage(7.25 hr) and I would no longer recieve insurance. I have not responded to them, and am still getting my insurance but I am in limbo I applied for another job and my old company stated I was still employed with them. I really am not sure what to do because I still need my insurance badly but I also need to start working again.
