Discrimination

I am working at company as a long term temporary employee. Recently a position opened up that is nearly identical to the last job I had. It is in the same industry filling out the same government forms with the same deadlines but with smaller clients than I had before. Perfect fit. I applied for it and the V.P. called me into her office and said it has a lot of phone work and she is concerned about my hearing. I wear hearing aids. I have worn them for many years and they don't stop me from hearing on the phone. I was taking back and didn't say much but now I have taking on much of this positions duties without the pay or benefits. Since I am a "temporary employee" do I still have the right to go to HR? This company claims to not discriminate of the basis of race, sex, religion, national origin, age, DISABILITY or genetics. Do I go to HR or call an attorney?

I'd go to HR first and if they don't solve the discrimination then I'd look for an attorney that can help you claim discrimination

Schedule a meeting with the E.E.O.C. take your documents proving your disabilities and file a complaint under the ADA Act. Now once the company receives notification look for enuendos and harrassment to increase, keep a detailed record of all incidents. Even though you are classified as a temporary employee the company can only keep you at that status for a short period of 3-6 months, reason being they are not trying to pay full benefits, pension etc. Check out the case of Compaq computer company for more details.

My suggestion to you is to call the Equal Opportunity and tell them what HR told you and let them tell you what to do. They can not discriminate you in their company because they are discriminated against the disability act and in their, it says that no company can discriminate against your race, religion, sex, gender. So you have a right to any job in that place because they have to treat you like a normal person. I understand where you are coming from because I wear hearing too. Do you know that companies get money from the state of Ohio for people who are a disability?

what you need to do is call equal opportunity and tell them what HR told you and tell them the situation and let them suggest what to do. I understand because I wear hearing aids to and I get a lot of things throw at me all the time on my job. The job can not discriminate against you because of your hearing because they are getting money from the state of Ohio and the are going against the Disability Act which they can not do that to you.

File a report with EEO, make sure that you document date, time and everything that was said.. Then report it to HR.. That's what I would do.

Well it's a tough call. I used to manage a lot of people so you run the risk of pissing your boss off. You are in the right but no lawyer can stop the dominant group Everytime. So ask your self if it's worth it. If so you will win but may not work for that company again
