I got fired over a knee injury

I got fired over a knee injury that limited me to not be able to do 3 out 16 things my job required me to do. I am now suing for wrongful termination and discrimination. I was a twos preschool teacher.

You are goijg to win this., they will settle. Since you were a school teacher, an organization owned funded and regulated through the goverment. As of 2016 affirmitive action is mandatory for goverment run programs. Not to mention the negative publicity the school will recieve. No judge will side with the school, and increase unemployment for a public servant. In the mean time, talk to the schools biggest rivals and see which one will hire you. In the eyea of the community, they will be viewed as heros who have a moral to the story for students and staff.

Dara they can’t just fire you. If you hurt yourself at work it’s considered a work injury. Yes you can sue the school district or whoever you are working for. The company pays for all of your medical and medicine for your knee injury only. I would hire a workman’s comp attorney and wait for your money. But do not do anything you are not suppose to do. For example if the doctor tells you you can’t go dancing don’t go get caught dancing. If he/she tells you can’t run, don’t get caught running. What I am trying to tell you is Workman comp had spies. People who are hired to watch you for a couple of days. And trust me you don’t know they’re watching. If you get caught doing something that you are not supposed to be doing on that knee injury well you are done. Not only will you get nothing, but now the company can charge you with fraud. Hope this helps.

If you went through an agency for your job you should have short term disability. Good luck with your lawsuit.

Depends on what state you're employed in. If you're under contract & you can't perform your duties, whether it's 1 or 20, then you can't do the job & they need someone that's all efficient. Also, some states are allowed to let an employee go without cause. We live in a sue-happy world & not everything is compensatable

Hi Dara,

The company is supposed to engage you in the reasonable accommodation process. Did you provide them with medical documentation? If the duties were an essential function then the company can let you go or provide you with modifications add long as your doctor puts it in writing. Focus oon getting better so that you will be in position to seek other employment or possibly return.

How will the 3 things get done that you can’t do? If you didn’t get hurt at work and can’t do the work then they need to find someone who can. Move on to something you can do.

That doesn't make sense for people to lose there job cause of a leg injury. The company is suppose to work with people with that type of a problem.

The capitalist system considers the worker as a mean of production. The owner of the business has more rights since he pays lot of taxes.
