Scars and Dress Code Discrimination

Hey! I have worked at a restaurant for about 5.5 months and have followed the dress code perfectly. I am a great employee and management has told me that many times and I was promoted about a month ago. Today, out of the blue, I was told that I am no longer allowed to wear dresses or outfits that show my legs because of my "skin condition." My "skin condition" is scars from a little over a year ago that did originate as a medical condition. They are now just dark marks on my legs. I have learned to live with them and not care who sees. I would love some opinions on whether this is a valid decision on my employer's part or something that I should fight.

Hi Ali, I will first off state I am not an attorney before I comment. So a few things to consider when approaching this; what exactly is stated in the employee handbook about dresses? Two, if this condition is caused by a medical reason and the dresses help your legs and skin breathe or help because they are less constricting you might want to start that conversation IN WRITING and cc'd to your email or photocopied about starting an ADA interactive process. There isn't a law that protects dress code unless it is for religious or medical purposes under EEO. If you need further guidance, you may seek an attorney's help or contact the local EEO office and they might better assist you. If you have further questions feel free to ask. Good luck! Jess
