
Don't know what to do....
Yesterday I found out that the company that I've been working for a little over a year now, has been cheating me, here and there, on my checks. You ask how... Well, I haven't received a single checkstub the entire time I've worked for them... And Yes, I have been nagging them and they say "They've been sending them".. I've even made sure they had the right address multiple times but nothing. So yesterday, I finally went down to the office and got my stubs. To find out that my suspicions were right and they've been shorting me 15- 30 minutes here and there, the whole time. They said that they can not pay back those hours because it's not their fault, that it's the computer clocking me in 15 mins late. I am a Home health care provider. I have two Amazing client's that live next door to each other so , I just walk from one home to the other's. So when I clock into my second client's shift, there's only minutes between. Well the computer has been clocking me in late by 15 mins. I've had other problems with this company and am fed up! But I don't want to leave my Amazing client's... Both clients offered on their own, to change companies, if I chose to leave. I'm barely making minimum wage. I just don't think it's fair to my client's. Don't know what to do...

Well your clients are willing to switch with you so that's a definite plus!! The company sounds like outback steakhouse that I worked for here in white plains ny was doing that or deleting days on employees. So you need to find another company or go to human resources and see if they can fix the problem cause that's a lot of money they've cheated you out of. We'd be arrested for larseny if we did that but companies can get away it like it's allowed.

This is a case for the Labor Department of the US Government. I would contact OSHA and the US Attorney office, William Barr, by letter and describe your situation and let him advise you to the steps you need to take. And be sure to tell your company, after you have contacted him, that is what you have done. Then see whose "fault" they will fall back on. To short change an employee of hours and money is a federal offense and is punishable by time in federal prison.

Type your city and state and Labor and Employment Law Pro Bono on google. They will take 20% of your settlement, but your portion will be much more than what you were cheated.

Are there other home health care agencies in your area? I would definitely apply to others, and it sounds like your 2 clients will undoubtedly follow you. I would also report your company to the labor board & BBB.
