Non-Compete, job eliminated & Severance

My job was eliminated because of lack of work. I have a non-compete. If I am receiving severance until the end of September, when can I start a new job?

UPDATE - All of you are wonderful who commented and are gratefully appreciated! After the fear of retaliation with the non-compete...I started a new career as a case manager at a personal injury law firm. What a breath of fresh air! Good luck to all!

Thank you for the response. They are paying me bi-weekly for the severance just like when I worked there. Great point about asking them to waive my non-compete.

A few thoughts: 1) can you ask your prior company waive your non compete in general? Often companies will do that, esp in a recession, to help their employees get back to work. 2) when you have an offer can you inform your prior company to ask them to waive your non compete for that new company? 3) if not, you might want to talk to a lawyer to see if your non compete is valid. Did they pay your severance up front or are they paying it monthly?

I consider non-compete clauses to be complete rubbish. If the company does not wish you to be hired by their competitor then they should not let go of you. To me they are completely ignorable. The whole idea of severance pay was to tied over an ex-employee until he/she could get a new job. Vendors to companies don't sign non-compete clauses. When did this become a thing?

I had a non compete. It meant that I couldn't start a company that competed with my company, not that I couldn't work for a competitor.

Thank you for the response but what about my severance. If I start a job with an afiliante (vendor) can they stop my severance pay?

You can use your work experience at new job ASAP you just can’t share info regarding competitive wise for example I worked for a Pharmaceutical company, obviously I can go to a different pharmaceutical company just can’t use my old contacts for patient leads etc.

What is the nature of your previous work? Industry and your capacity? Some company can be very mean. You need to read the doc in an entirety.

Generally, none competes have to be resigned every so many years to be Valid. Different states have different rules. Read the none compete and see how it applies in your state. Try something different. A job now means you beat then end of extra unemployment rush.
