Discrimination

A group of us over 40 waiters just filed a complaint with eeoc about a new corporate restaurant we just helped open for age discrimination because of how they treat waiters over 40 with hostility. We also said our grievance to the corporate office. They agreed to transfer us to a different location but I don't think they got the letter from eeoc yet. Is it ok to still work for them even though there's a lawsuit pending?

Yes, but watch your back and document, document, document. Dates and times. You need to get a union to represent you pronto.

We just had a conference with HR and the managers. They were trying to cover their butts even lie at times. They offered us to come back at work as thought they are worried. 2 of us said we need a week to decide and 1 said he won't come back.

Yes, continue to work, you need your job. Please, please stay on top of the EEOC. They can be very lack of you don't make them know how serious you are. I know from personal experience, I'm sorry to say. They ended up being no help at all, and actual waste of time. I am glad you went to them but in addition try to talk with a lawyer, some can tell if you may have a case separate from the EEOC. On a side note, be sure that the EEOC makes this case public, no matter the outcome, so other people and businesses will know that the company was charged with discrimination, specifically age discrimination.

We will ask them for the settlement. They are so guilty it's not even funny anymore. Plus I'm sure they don't want the publicity. I mean picking on an Army and Marine veterans?

Honestly don't continue to work for them until that lawsuit is over I advised you to find another job and don't let them get the best of you that will give them a stronger case against you.trust in the Lord with all thine heart and lean unto thine own understanding

U should ask the lawyers or advocate who is advocating for u all. In my opinion, until u get another job it should be OK. But you've got to be on top of your game cuz if I aren't u will give them true ammunition to terminate u!
