Terminated as well

I need some advise regarding termination as well. I am a widow of 19 months; my husband (soulmate) passed away unexpectedly in April 2017. By September of 2017, I took short term disability to work through my grief and try to figure out what was also wrong with my right knee. I got cortisone shots for the knee, and a 3 shot series of glucosamine to try to help. I went back to work in January of 2018, walking with a cane. I ended up tearing my meniscus, and ended up on short term disability again and had a partial knee replacement on 2/28/2018. Right before my surgery, my boss called me (with HR on the line) to tell me that I was going to be replaced. Note - FMLA was in play the first time, not the second. I had the surgery, recovered, and then after applying for a different job (for which I was overqualified) I was "done" officially on 7/6/2018. Since then, I have applied for numerous positions, interviewed, and when asked, I advised that I was not "fully utilized" in my position. I truly wasn't. Since I have been off work, I have written a book and it will be published shortly. What do you suggest that I say about "leaving" my last job? I would rather be truthful, but I know that the truth isn't what people want to hear. Thanks!

Chris, I went through the same situation. I lost my husband in August of 2017 and had to literally reinvent myself and my skills. I did it and now I can happily say I work for the Census Bureau as a recruiter to get people jobs. If you are interested they are hiring until April of 2020. 2020census.gov/jobs. TYJ

Sounds kinda like me. I am a very hard worker, last year I was off 3 months for surgery on my shoulder, then the 1st of the year. I was off for a month for a heart cath. I worked for this company for 9 years. I went in early, stayed late, came in on my days off. I am 62 and I was making top pay so they let me go, they are hiring young people and paying them a lot less. I have been off work for about 3 months now and I can't find a job, thank God I get unemployment for about 3 more months.

According to NYState FMLA can be used as often as needed unless you used the total allotted time from your first time you left work. You are allowed 12 weeks according to NYS if you use all that time and have to go out again your job is not held for you and can be terminated you have a 12 month waiting period after you came back from the first 12 weeks of FMLA you have to wait a year before you use it again.
