Permanently Blacklisted

Can someone be permanently blacklisted for failing a drug test? Is that even legal? I failed a drug test for a good job back in February this year. Yeah, I admit I was using a little marijuana back then but I haven't touched any drugs or alcohol since then, not even a beer! Circumstances in my life have changed dramatically since my father died so I've been trying to get my life in order. Problem is that all the jobs I'm applying for now tell me that I don't qualify because of the drug test. Is there a national blacklist my name got added to because I previously failed a drug test? How can I get my name off the list?

In certain industries, like transportation, yes, you can be blacklisted for failing a drug test. There is a national registry, especially if you're a truck driver, that lists if you have ever failed a drug test. This is for safety reasons. I would assume the same for pilots or vessel captains. You can overcome it by taking drug abuse classes, but that record still will remain. It's kind of like a criminal rap sheet. I've known truck drivers busted for marijuana and CBP (yes both are illegal federally for truckers) and recovered, but it's very hard.

TAKE AN INDEPENDENTANT DRUG TEST, & show it to the next interview employer & do their test with one of their witnesses to prove you didn't try to PULL any fraudulent crap * PS, DO NOT be hanging around ANY of your buddies while they're getting HIGH & your catching a "CONTACT HIGH' by inhaling that garbage *

Chances of getting hired a company where you failed a drug test are slim to none. I suggest that you take those companies off your list.

Michael, there is no such thing as a blacklist. Employers just don't have a monthly coffee break and compare notes about who can never be hired. Aside from not being cost effective it's impossible to do. What I absolutely can tell you is that your chances with that particular employer have been ruined. Further, the only drug test an employer can refer to is the one that they have you take for their employment requirements. They cannot refer to any other medical records due to strict privacy laws unless you give written permission. I hope this helps.

Nothing goes on your record on a pre-employment drug screen because your still not an employee.

I can't imagine they would blacklist for failing a drug test one time. That seems really unfair. Have you tried to figure out why you would be "failing" the drug test if you aren't taking anything? I think some prescription drugs can actually show up in a drug test.
