Can you be fired while on medical leave?

You'll need a medical note to show you hurt yourself on the job and you should try to contact HR for employment discrimination and see if you can get a severage pay and filed a EEOC discrimination.

Yes they can...I got fired from my job of 2 years....I had strict dr’s orders not to work and they did not care because the company has certain policies that must be followed or you’re due for automatic termination....

This is crazy but true. I think of the situation from both points though. Yes you are ill, but shouldn't be punished because you are sick. Two is they have a company to run. Life is unfair.

I was fired while on medical leave my doctor had not released me to return to work and the days allotted me by the employer had expired. I contacted my employer or HR. And was not able to speak to the lady in HR.because she left early that day. I took the paperwork to the office but to my dismay. She called me and fired me over the phone.. Paperwork was sent to me to file for a hearing and the final notice I received said I quit my job . I did not have the energy to fight for it so I let it go.

OH hell no ...Im on a Union Contract and I know they cant doo it there ...But I do remember working nightmare non union jobs ...Just need to call the Laber board ...Id be Soooooo Happy for sure

Okay, I'm no lawyer,but I think that any company headed by someone with a brain (I'm not counting on them having a heart) would realize at least that coming to work with the flu lowers everyone's productivity. Staying home when you have the flu is the right thing to do, and I hope you will be able to recover and find a new job where they won't hold this firing against you. You did nothing wrong.
