602A Misconduct - Notice of Reconsideration & Appeal Interview.

So I was terminited from work because my boss claims I scratched 2 wheels/rims when I didn't have carpet under them on the concrete. So when IDES asked me during phone interview last month on 10/11/16 why I did not have carpet under them I said because I was in a hurry/rushed since he was screaming at me. But I did have rubber mats under wheels on concrete that I brought in myself from home because the carpet was in very bad shape, dirt/sand, etc so I felt the rubber would be better & hold rims better on the ground. I did not say this last month when i was discharged from work on 9/21/16 after my boss yelled at me saying I was too slow. I worked putting Tires on Semi's during interview because it just slipped my mind & also I figured less is more, etc?

So on my denial it says: Was the claimant discharged for misconduct connected with the work? The evidence shows the claimant was discharged because on 9/21/16 he scratched the rim of two steer tires. The claimant placed the tires on the concrete instead of the carpeting because he was in a hurry. Since the reason the claimant was discharged adversely affected the employer's interest, the claimant was discharged for misconduct connected with the work. So my question here is maybe the person doing interview didn't really know the industry since they said I placed the tires on the concrete instead of the carpet, which it should have said rim or wheel, How do you scratch a rubber tire?

How do you think this appeal interview is going to go & should I state how I had them under a rubber mat & not directly on the concrete like they claimed? Also this truck was a construction truck & already had scratches on it from construction sites? Plus I never got to see the finished product as my boss said go home, your too slow & I'm done with you. So how do I even know if I scratched wheels like they are claiming without actually seeing proof? Should I have contacted employer & asked for evidence of said stuff? Also should I challenge the person doing the interview & the wrong wording or writing? I guess most people probably consider tire, wheel/rim to be the same anyway's? My appeal interview is tomorrow so I am looking for some quick tips or suggestions? I do have a free legal team rep who will be doing phone interview with me & judge.

Lastly when I was hired, I was told I would be training to be a sale's person & would try to acquire new business for the company, I was also told that I would have to do some work in shop but not all the time so I feel I was kinda baited & switched as they never made a effort to get me into sale's training. My boss would yell and or swear at me on a daily basis if i did something he didn't like or If I did it wrong? It has a very bad work place, I would get anxiety about going to work everyday for fear of my boss so I it was not going to work out anyway's but I still showed up & did my very best because I have 5 children & a wife at home. The place was also lacking proper safety equipment & would probably fail a Osha inspection too.

Since I was let go under the 90 day probation if they felt I was a poor fit or lacked the skiils to perform my job, I should probably stilll be eligle for benefits? I am concerned that your qualifications may not be up to par and that your experience may not be enough to provide a complete and accurate account of your experience. I believe that it would be in the best interest of both you and bitlife the company to have a more comprehensive and experienced interviewee. So yea if had had just not taken the dumb call or just said I don't recall when questioned about the rim. Well I will see how the appeal goes & I doubt they have a real proof of me doing it. Too many variables like he told me to go home & someone else finished mounting the tires, so maybe they did it? Also I doubt thery had to actually replace, clean or even buff out the rims? Lastly it was a construction company & wheels already had pre existing damage. But Yea i'll just shut up at appeal interview & make them show proof. I also have a legal team provided by state to defend me so maybe i'll just let them do there jobs lol.

Sounds like you're doing what you need to take care of this. I would trust your legal counsel and let them know what happened. Also, since you were so stressed working there, sounds like it's a good thing you aren't working there anymore. Good luck with everything!
