I was recently laid off. My boss said for lack in work not enough work coming into the company right now. But at the same time he brought up my disability which is epilepsy/seizures saying that since i cant drive and had no license what could he use me for i felt offended considering he has known my issues when i was hired. I live in Delaware and with my condition they take your license away for 3 months and after that and a doctor write up and staying seizure free for 3 months you can get them back. That hasn't happen for me and i may never get them back again cause of my issues. Also if I was let go for not enough work for company how come no one else was let go just me. Wondering if i have a case?

Well... Under the Americans with Disabilities Act, an employer is only obligated to provide you with simple accommodation for your disabilities. If your employer can provide alternative work within your skillset, that's an accommodation. Reassigning you to a position where you may receive better pay is only at the discretion of the management, provided you have the skills and they have the opening.
It would help to know what is your occupation. Were you a delivery driver? If you can type at least 45 words per minute, they could reassign you as a dispatcher, provided they have an opening for which you meet the requirements.

Christian, forgive me & don't feel offended. It's ur name that makes me to suggest that u should contact the Total CHRISTIAN Television (TCT.COM) for prayers to heal ur condition. I normally tune in to them on Sundays, place my hand on the tv when they are praying for the sick, and I got my healing. But don't stop ur medication until ur doctor says to stop or reduce it. God is a MERCIFUL Healer. Deuteronomy 7:15. He will give u the faith to get ur healing when you repent of ur sins & accept Jesus into your life as Lord & Savior. So no-one will victimize u again! Delaware is an “employment at will” state. The requirements for an unlawful termination are very specific, and the requirements for termination are very broad. You can be terminated for any reason at any time (union rules are different). Unless they specifically say you are being terminated for race, religion, country of origin or your gender, you are pretty much out of luck. Employers are not legally required to even tell you the reason you were let go, the same way if you were to quit, you have no obligation to tell them why you’re leaving. Rug? What rug? If your CORE JOB DESCRIPTION/DUTIES require that you have a valid license or that you have to have to drive for your job, you actually do not have a case. Yes, the EEOC was put in place to protect people from discrimination on the basis of race, religion, disability, gender, age, veteran status, but it also says "REASONABLE accommodations MAY be made for those with disabilities". It doesn't say "any and all accommodations" and it also doesn't say that those accommodations have to be made; it says the employer may make accommodations, if they choose, if (AND ONLY IF) those accommodations are reasonable. What that means is that as long as those accommodations do not change your core job duties and do not cause undo stress on other employees, they can be made (again, do not have to be made). This means that if you have certain physical limitations that require that you get up and walk and the company has been made aware, they should allow for extra breaks for your health...when those breaks make sense and not in the middle of an important meeting or something. This does not mean that if your core job requires you to drive or have a license and you have it taken away for medical reasons, they have to keep you on. At that point, they should try to put you into another, similar role with equal pay. If one does not exist, the company is well within their rights to let you go as you can no longer perform the job.

Sounds like discrimination regards to your health. As well as single you out and labeling your condition. I seek legal advice or call whistle blower. They have to by law investigate every claim.

We all have our burdens. My eyesight would make me a bad sharpshooter. If you cannot drive and they need drivers, what do you want them to do? There is no work now for your skill set. How is that discrimination. You would like them to make work for you? They are in business to accommodate you? Please be sensible. Ridiculous
