California sick time approval

I’ve read that an employer can not deny sick time if it is for health reasons or family emergencies and they can not consequent you with points. Yet my employer has a policy where your supervisor has to approve my time and they can decide not to so I have racked up a hand full of points in this case. And yes I’ve only used any sick hours I have earned. Any thoughts or advice ?

Hi Garrett Sloan - great question. Sick time leave depends widely on the state. You can find more information on this website about it.

I think that this part is the most applicable to your case: "This means, in general terms, that if an employee has accrued sick days available, an employer may not deny the employee the right to use those accrued paid sick days, including the right to use paid sick leave for a partial day (e.g., to attend a doctor’s appointment), and may not discipline the employee for doing so."

To me, it sounds like they are not following the new sick leave law. I'd reach out to your local labor board to be sure, but I think you are in the right here.

Best of luck in your situation. I don't know why an employer would want to ruin a relationship with an employee by denying rightfully earned sick time. Also, if you are sick why would they want you to come in and get everyone else sick? It doesn't make sense to me.

I know Debbie Laws works in HR in California and has provided some amazing advice in the past regarding workplace problems. I'm certain she will be able to offer some insights into the matter! Please let us know how things turn out!
