I have been getting denied jobs because I have a pending criminal charge is this discrimination since I have not been convicted

Gayle, Curious, how are these companies notifying about information pertaining to your personal record, phone, email, letter? Once you sign consent to background investigation employers or agencies conducting the check are supposed to provide a copy of the records being forwarded to the potential employers. I suggest checking where the erroneous information is originating and follow-up accordingly.

I don't know where you live, but it is not discrimination in Pennsylvania....at least not in the "legal" sense. Many acts are "discriminatory", but they are not covered under the law. For example, a former coworker of mine who works in human resources for a large employer shared with me that the employer "discriminates" against applicants based on their zip code of residence. Perfectly legal, but not moral.

Hi Gayle, thanks for posting to Jobcase! Discrimination only applies to when you've been denied or fired from a job due to your race, sex, ethnicity, religion, sexual preference, etc. So in your case, it doesn't sound like you're being discriminated against. Have employers told you it's because of your pending criminal charge?
Hi Gayle, I'm a felon and a welder my felony charges were teen years ago I've been out for two years now and still can't get a job as a welder.So I know where your coming from. People make bad choices and decisions and they pay for it, but how long should one pay. That is a problem in America people get sent to jail and then pushed aside . People need a second chance to prove them self different to what they were convicted of. Keep your head up girl.
