
Is this legal???
Hello all! I work a job not making much at all! The issue is I decided to pick up some over night shifts to increase my check. Upon getting my check it wasn't right so I asked my supervisor abt it and I was told doing over night shifts I get paid a flat rate instead of my hourly rate and that I should've bn told this upon accepting the shifts! I wasn't told this at all... Is there anything I can do other than quiting? I mean I worked 60 hours. Supervisor said because it was simply a sleep over shift! Now if I had only slept, it wouldn't be a big deal but I was literally up ever two hours assisting and to me tht just doesn't seem fair at all. If I had been told that up front, I wouldn't have accepted the assignment to begin with!

I want any job no problem... please i am very poor boy can you help me . Any friend help me please

Tomika, This is a clear violation of the Fair Labor Standard Act (FLSA). Call your local Department of Labor, they will investigate without mentioning your name or that it was you that called.

Tomika, Ouch! This is scenio that should not have been a surprise. Obviously, your employer has operations overnights and potentially 24/7. Usually there’s a shift differential wage for 2nd or 3rd shift work in which is usually a higher wage rate. Typically, this is an incentive for employees to work these more challenging hours. It’s ok to question your wages. I would recommend speaking with your payroll department, then your HR or ER representative for a complete explanation around how and why you were paid differently than expected. Additionally, you should see some explanation in your EE handbook. What you received as compensation, if not an error, for your extra hours may be legal based on state laws however, it doesn’t sound as if you were well informed and this is somewhat unethical. Good luck with your inquiries.

I would talk to your HR rep and they should tell you how it goes. But there's something not rite there. ( when you were hired did they give you a employees hand book if so check it thoroughly. Hilight all that applies as far as hours worked and paid. If this is not true point it out to the HR rep if the don't fix or give you back pay. Then report them to the EEOC they will do an investigation on the company and make things rite. But be sure you document your hrs work so you can get the adjustments.

In my opinion, since you asked... I believe the responsibility falls on you! You, as much as I hate to say this...should have done your research and asked what the pay would be. This one’s on you....so....,suck it up buttercup! We learn from our mistakes! Lesson learned!

Hey .. this is horrible .. I am so sorry your going thru this .. ok A . Did you sign anything g that tell you that it’s a flat rate ( I am assuming no ) so that unlawful already B hell yea reach out to the department of labor . And 60 hours that’s crazy !!!!! Let us know what the out come is !!

Talk to the Department of Labor. Far as I know there's no such thing as a "flat rate" unless it's a specified hourly pay, but usually that only applies to 40 hours or less.
The fact that you were not told was a communication error on their part and it would only be fair if you got some form of compensation (even if it's not in the form of a paycheck). Though the chances of that, unfortunately, are not high and the one responsible for giving you that information is likely only to be lectured for their mistake.

Let them know how you fee. Hit the ball back in there court. If they drop it. There's your sign. Just make sure you BELIEVE IN YOURSELF AND THE BIG GUY upstairs. Doors will open and close your hole life. Most always if you trust in a higher power. Have a great day my brother!!
