I was going for a random UA and did so when the gal Lost the urine sample she tried to blame me for losing it and I said I didn't touch it and she called in a manager I said I would take another UA the manager said that's fine but when they called HR HR said that I was to be terminated immediately I told him to search me I lifted up my shirt my pants everything and they wouldn't give me a chance for another urine sample and they told me to leave the premises immediately what's wrong with that picture

Dana, did you give your UA sample at your place of employment or at an outside facility? Please provide more details to help us better understand what actually went on.

Hello Dana, as far as UA' s go, you are either accompanied by a lab tech to make sure you have not brought another person's "clean" sample in for testing . If you were alone while providing the sample, you DID touch the U.A. cup. If you were monitored during the UA, the tech would be responsible.

It wasn't your problem, she was the irresponsible. Just tell her ok and go to higher legall standard. Don't set and dwell on it.

PS - I would not call HR and investigate on my own. I would simply allow an attorney to discover their records through a legal process called "discovery", LOL. Going back and forth with the employer on your own in anyway will simply muddy up the trail and provide them an opportunity to trip you up into saying something that may be used against you. I'll bet that the employer here has already sought counsel and is implementing damage control procedures. They may even have insurance to protect them from incurring immediate cost as they navigate this potential calamity. That is what Risk Managers do for employers.

Look for an attorney quick, fast and in a hurry. HR must have a process in place to prevent this sort of she said, he said event. The chain of custody evolved from employers losing court cases that framed the exact scenario you laid out. I doubt that you'll get your job back or that the employer will allow it to go to court. Sounds like a slam dunk case. If you don't have an attorney by now you are wasting time.

It sounds like ,they wanted you gone and what easy way to do so . I would talk to a lawyer and see what can be done, cause after you hand it over to the person taking your cup they have to long it in and everything, sounds like she left it or dumped it and didnt long it in that she got it. Hope everything works out.

There is a chain of custody process when you provide the sample and handed to the person administrating the test it is no longer your responsibility and should be logged in. Look into the process and procedure.
I think I would claim unemployment at the very least. I believe the employer would have to pay some amount of money to the state, and if they refused, they would have to give an explanation, and you would also be offered the chance to explain your side. Do whatever you can to fight this.
