Wrongful Termination

If the company fired you without a warning either verbal, preferably a written warning then it was definitely a wrongful termination. Without prior warnings or disciplinary written report, then you could take them to task. However remember NJ and NY are "At Will" states, meaning employers have the right to fire or layoff their employees without prior notice whenever they deem it necessary.

I was fired from my job because I was on the clock when I was physically assaulted at work. Also that same place won't pay my workman's compensation from when I was in the hospital with a brain bleed due to head trauma ensued by the assault. My job knew this person was a threat and they still did nothing to help me.

That's California as well. Question, then why do we have laws, such as wrongful termination? If you can be fired at will? Or if the management lies, makes things up in order to fire you? That is destroying a person life, career, income not just a job! I was fired at 66 and after working 10 years, and they are still doing it other employees. Why have laws that really do not help the employee????? Really, what is wrongful termination??

I was never fired, my boss actually told my mom I couldn’t come back. She had my number, I worked hard and was alway there and on time.

After 3 hand surgeries for the companies negligence and retaliation, I returned to work and got walked-out for 10 day’s bc I did not use my thumb to hold down a 3lb.+, button that gets a clamp used on it in other parts of the factory. My Shop Chairman was behind this retaliation. I was watched closely on third shift for a week, then asked for my 2 weeks of vacation to take care of my Dad & Mom in Michigan (which I had paper work for family leave besides enough vacation) instead JD had me walked out.

That is exactly what happen, they call me to come to the office on a Sunday after having worked all week telling me not to return to work next week, I was so shocked and stressed until to speak to think that I could not return to work, so what can do now, Thanks
