
Ex-Employer Forgery?
Hi, all! I feel a little awkward in revealing what I believe to be forgery. [A long post, but pls tell me what you think]
How easy is it for a company to forge evidence against an employee to incriminate him/her? my previous employer here is not listed in my profile.
I lost an unemployment comp claim for reasons of supposedly receiving previous warning for misconduct.
The part of the decision I don't agree with is that I received "previous warning" and exhibited "actual" or "threatened misconduct" after that fact.
I KNOW that I had not received warning for the misconduct, which was altogether accidental, but it was STILL misconduct, and "that" I never once denied in the claim process.
I have no hard feelings against my previous employer, and I am a part of a new business culture. Yet with how everything was "set up" with my previous employer, there was absolutely "NOTHING" (other than a written statement) that I could provide as evidence to prove my innocence! All warnings were electronic, and stationary of any sort was strictly prohibited.
I already understood the culture of my previous employer, who had been part of a class action lawsuit with its employees some time before for other reasons, but it is still hard to believe that a company would go to such lengths to justify itself, even at the expense of the ex-employee's very own livelihood and future!

@Deon, First, very well written! Second,you must remember there are some very sordid and sick people out in the real world. These alleged employer feel that they are potential "GODS" with no barriers and can destroy whom ever they target or please. In closing, please just remember you are NOT the problem these power hungry,over zealous companies and corporations are the major plight in today's hostile Job environment !

I KNOW HOW YOU FEEL. I JUST WON A UNEMPLOYMENT CLAIM AGAINST MY FROMER EMPLOYER. THERE WAS KNOW EVIDENCE OF MISCONDUCT. JUST HERESAY.I THINK A COMPANY WILL GO TO YOUR EXTENT. GOOD LUCK.

Was your signature on the complaints? Where the signature exactly alike? If so that is forgery because no one writes their name the same each time. It's not hard to believe because if they where wrong they could be fined lots and money and owe you even more money.

Hi Deon! It is a sad state of affairs when employers are unethical. Here's what I recommend, upon termination. (voluntary or non-voluntary) ask for a copy of your employment file. I know that a lot of companies have them electronical these days, but everything should have a manuel signature, especially for reviews and disciplinary warnings. Therefore, most are scanned in. Give the employer 24 hours notice. I hope you find a new job soon. And remember, an interview is a two way street. You are interviewing them as well. Be sure to ask them questions in the area of ethics. Good luck!
P.s. it's not too late to get a copy of your employment records. If something in there looks wrong, an item concerning forgery, get in touch with your local State Workforce Center.

Call an Employment Attorney and ask them. There's no charge for a question over the phone. Don't do it on line or give credit card info.

Concerning your question, it is relatively easy for documents to be forged. Sorry. But you really are at their mercy UNLESS you have documentation of your own that can be demonstrated to be original and accurate. Some people mail themselves documents so that the cancelled stamp "documents" the date. Just open it in court. Some people photograph newspapers with the date prominent. Still others use gps timestamps. There are multiple ways to document time/date. Using a computer file is not a way since a computer's time/date can be set to just about anything within the realm of computers.
