Quick question tht I would like to know and pass on bc I've been asked this as well but haven't been able to give a clear answer to....if u have an accident at work and required to take a drug test...then pass the drug test can you then be fired after passing the test...and is there anything you can do about the termination....

Your drug test past ? Did they tell you the reason or just not put you on the calendar to work until you quit? I don't believe they can terminate you without a good reason. Well if it states in your contract which is all the paperwork you signed when hired, tax forms and such about a no tolerances policy , yes they can. Accident like what? Were you not wearing safety gear or someelse get hurt or / and is this your first write up? This all matters . Maybe you should look up the rules of this company before getting a lawyer but if there is nothing call the labor board. They will handle it for you.

Hell no, if you are clean from drugs it is illegal to fire you....that is a no brained..... If you are asked if you commit murder, and you say no and are proved innocent....can they hang you.... Get real people......

Yes. I'm guessing there is a company policy against whatever it is you did that caused the accident. Some companies drug test and will offer rehab if you ARE on drugs. If you are not, they may decide the damage was willful. They most likely felt that you either didn't follow procedure, or were purposely being destructive.

Only logical reason for termination after passing drug screen, if the accident had been caused or some fault of Your's. Haven't any idea about actions to take, question for Human Resoarses.

if you are injured on the job, you need to apply for workers compensation immediately and get an attorney.

Michigan is an at will employment state. Unless it was a union job you can be fired whenever for whatever reason they want to give you.

Maurice, typically the drug test after in accident is an insurance issue. If the company is faced in any way with a workman's comp claim, they must have a drug test administered as quick as possible. At that point it comes down to what caused the accident. If the cause was negligence on your part, yes you can be terminated. The drug test and the punitive action is two separate issues. Each company is different, but the drug test covers them in regards to insurance risk. Good Luck...
Oh yeah,I had an inspection job years ago that one of the iron workers fell and hurt himself.He failed the drug test and got fired.He got a labor lawyer and got his job back because at the time the drug test was not mandated by the state .
