I applied to a hospital and got hired. I did a drug screen for the HR department and I have a prescription and the screening company asked the Dr what this medication was, but he isn't privileged to say. HR asked for more information which I consented. now the medication is for a brain tumor that isn't the hospitals right to know. now I won't get the job. can they do that. deny me for a medication for a pre existing condition they aren't required to know about.

Dear Michelle, first, I'm so sorry you did not get the job, but that's okay. It really, really is. I will tell you why in a minute or two. To answer your question. I'm not sure, but I' m making it my business to find out. However, most states be has in place, in their favor- no question, no reason law that says they can fire you or not hire for little or o reason at all. What I have found in my own way is that, the powers that be has just another old fashioned way to discriminate under using this flimsy law that benefits the employers who is now laughing at this very law, almost in the law makers face. I would think a required medication, would be the exception, since it's not the same as street drugs. By the way, legal Aid Society is a very help in these things and so is ACLU. Please, remember this. I don't know where you stand as a Christian believer, and It do t matter for my next point. Sometimes God has something g far better than that you retched at and could'nt get. So please don't up. You will get there, no just maybe not through this company.I feel that somehow, you will be glad this GS turned as they did. I came across the same situation recently. I was taking a narcotic pain medication for a herniated disc. All I had to do was fax them a copy of the position. Nowadays with jobs seeming so hard to find, I personally don't care what my employer knows about me.

I don't think that a company can dismiss or refuse to hire you for a legally prescribed medication. Under the ADA, no place of employment can deny you a position based on a disability, provided they can reasonably accommodate you. However, there's the whole insurance issue, which right now is a mess. The employer provided insurance could play a bearing on whether they hire you or not. I'm not sure that is legal. This is definitely an issue to talk to a lawyer about. Make sure, if you do, you talk to one who specializes in the ADA and labor laws, or something of that nature. I don't know if what happened to you is legal, but if it isn't, the hospital shouldn't get away with it. If it is, then it shouldn't be.

You were trying to get a job. That's also great but they didn't need to put you in that situation with them. They can't fix the problem unless you given them signed paperwork allowing them to do so. Somehow you gotten mixed up with the opportunity itself and instead they put you on medicine for conditions they weren't,like you said, wasn't supposed to know. My answer would be since you're there, ask them have they looked into the job opportunity you asked for awhile back. If they didn't medicine or not I would leave immediately until your paperwork is signed.

Now they violated the HIPAA law I would contact a lawyer immediately you have a good case on your hands

They have the right to confitm it is a legally physiciam prescribed drug. They do NOT have the right to knowlesdge of the actual condition you have that is being treated and regardless they cannot deny employment, save for those fields where that condition could pose a serious risk to the public as well as yourself. (Law enforcement, pilot, military, etc.) sounds like a violation of the Americans With Disabilities Act.
Im not really sure because that is discrimination but if you have any accidents that causes injuries to ur self or patient then u and hospital have problems.
