Unemployment question - boss trying to screw me over

Hi all, so my current job was sold to another facility. We are a gym and my boss/the owner has sold it to another gym. He told me that I should be able to keep my current position with the new owners/business. The new owner informed me that there is no position for me within the facility as the ownership transfers. Since technically my business is closing, I am in fact being laid off, but my current boss will not admit it. Tomorrow is the last day he's paying me, but he still hasn't admitted I'm laid off and he is trying to beat around the question and will not admit it. This is infuriating as I need my unemployment benefits while I search for new job. I have been in this company for 3 years and have been treated terribly by a scammy boss the entire time. How do I go about getting my unemployment if he won't admit that I'm laid off? Can he screw me over here? Should I take him to court?

Yes he is going to try and screw you over. But the thing here is to remember is to try and get you unemployment benefits. Work that last day and then go apply. You'll need to explain everything that you just put on this post to unemployment. Leave out nothing. Your story against his. After investigation they'll see that you are right and you'll get what is yours.

If you are working for a company that is closing, then you are indeed laid off regardless-you have no job to go back to nor a position open for you in the new purchasing company so you are laid off due to a lack of work. Your current boss can fight this all he wants to, but the burden of proof is on the employer to prove you have been fired or otherwise.....and it isn't because you've been fired. Make sure you keep all of the company closure info along with a statement from the new owner that there is no position for you and you will be fine. Always take it to arbitration if you have to, don't just give up if something he says you know is untrue. Get it all in writing if you can. The buyer of any business is not obligated in any way to keep any of the current staff unless it is part of the selling agreement. Stop waiting for him, you don't need to, nor are you obligated to.

Hi Natalie don't worry dear my job did the same thing to me I was there for 4 years perfect attendance and they let me go I called unemployment immediately and told them I got screwed they gave me my benefits cause wasn't let go due to misconduct they really go by the labor laws and they have your back call them right away and tell them your story with conviction tell the truth and you should be fine I'm still looking for a job it's been 3 months all I want is an interview I've applied to everyone keep at it I know you're bright I'm a drummer hope you can hear me play 757-817-9560

I would go to the unemployment office, and file for unemployment benefits right away.

The unemployment office will call your boss and ask him about your status. They will check that he has sold the property, and call the new owner of the facility to determine if you are going to be working there.

When the new owner says that you are not going to be working there anymore, the Unemployment office will have proof that you have been laid off.

You should have everything your boss says in writing.
