
Wrongful termination?
I have not had any prior written counseling for a company that I worked for ten years. I made a mistake of accusing a shopper who did not take anything from the store. According to company policy, only management are allowed to stop shoplifting and yet there are no loss prevention or security to help with the process. The shopper was never detained or touched. I only asked "Did you put something in your purse". The shopper said no and I apologized. The shopper said I will show you and went to the service desk to empty her purse in which I did not ask her to. I apologized again and offered her a gift card for her poor shopping experience in which she accepted. She gave hugs and left the store. She must have thought the gift card was not sufficient and file a complaint to our corporate office. A week later loss prevention does an investigation with the staff and I was let go for conduct unfitting of a manager. Mind you the company holds me accountable for the shrink numbers and offers no security. The store was just robbed recently and constant theft is happening with no loss prevention or security. Do I have a case for wrongful termination?

Hi Allen, I am sorry to hear your unfortunate experience with your employer. Here is my opinion of the situation. You said you had worked for the company for ten years, and this should have been enough for the company to recognize that you have been a loyal employee. First of all, if the company had such a problem with shop lifters, they should have invested by installing cameras or hire a security staff, and yet they depend on their employees to be their eyes and ears to protect the merchandise in the store. I cannot imagine how they came to a conclusion to terminate you while you are trying to protect their investment. My suggestion to you is to contact Department of Labor or the Employment Commission of the state you are in. They will tell you what steps you need to take. You might have to file a complaint against your employer. Your best bet is to contact them before you hire an attorney. Good luck.....Ed...

Sounds like walmart and sounds like something they would do too. I just recently left walmart after being misteated and harrassed for 9 months by my immediate supervisor and i reported it many times and never got any help at all it would stop for week or 2 then go right back then at the end when my manager who was friends with her also started and lied to my face to take up for her i knew i had enuff so i didnt go to work my next shift not wanting to work with the 2 together and i got a facebook message they were gonna fire me and claimed i had max points which i DID NOT at all so guess they were also somehow adding points to me so i decided i wasnt going back and havent been back and i do plan to discuss all this with the district manager yet which may b an option for u also. Man Sam Walton is rolling over n his grave doubt he is even in same place he was buried now. Like another mentioned tho most states r eoe now and they dont even have to have a reason to fire u which sucks i dont think that should b allowed there should have to b a reason esp n poor states like mine. This is also the same store where a worker came to work drunk hit an employees car and got arrested from work for being intoxicated and hitting car and was not fired they wanted to wait for court to c if found guilty what??? Really?? But yet all others fired for being a little slow stocking or missing a few days etc. But anyway best of luck andcyes let us know results

I agree with Mariah. You were not given any due process. Be sure to get a copy of company employee handbook. In there should be the steps they have chosen to remove people. Also ask for copies of all your past reviews that have to give them to you. Do not sign anything from them at all without talking to legal of your choice. Even though most states are right to work states- they have certain legal rules to follow.

When one door closes another opens. Maybe it's just time to move on. Take what you learned from this company and truly appreciate all the wonderful things you got from this job. Be grateful for those things. And although it's much harder, also be grateful for any hard lessons you've learned there, and all the hurts. And then let it all go and pick yourself up and create another wonderful opportunity for yourself. Sometimes the season for that job is over and you're ready for another season. What the next season is, it's all up to you. If moving on for you is exploring options for redress then do it. If the best outcome for you is take what you learned and move on, then do it. You're the only one with the correct answer for your life. Find your path and travel down it.

Allen unfortunately Virginia is a right to work state which means there does not have to even be a reason to termnate an employee.Therefore unless it was something that the company did that were against the federally protected catagories. ie; race religion, gender, age, disability. Etc...

Hello Allen, Most of us have negative experiences at the workplace. My best advise to you is to let this job go...... in other words, use it as a experience tool. Don't let this job experience bring you down. There is a better job out there for you. Put your positive hat on, update you Resume and continue (with a good attitude) to find new work. Companies have the upper hand when it comes to terminating and down sizing. Use the experience to make you stronger, learn from it, and move ahead to new job experiences. There is a better job for you...... go and find it either on your own or with the help of an employment recruiter. All the Best to You!!

Unfortunately Allen, as the saying goes : we can't fight "city hall". Companies now a days have the authority to let you go "at will" at any time. My best advise to you is to make this a learning experience and begin to look for another job. With a positive attitude, I am confident that you will find a more suited position and you will like the job much better. Things happen to us for a specific reason in life. Please keep a positive attitude, an uplifting demeanor and I am sure a better job will come your way. Don't let this experience "cripple" you. The company you previously worked for is not worth it.
That's horrible! You definitely have a case. Seek a lawyer about the employment laws
