Wrongful termination

I was fired after 5 years because I filed a complaint on my supervisor that was disrespectful I follow protocol however he was terminated two days before I was I asked for the reason they just told me that we could not have this kind of behavior on top of that I was denied unemployment and currently filing an appeal

It's called CYA; COVER YOUR ASS. THE COMPANY DID COVER THEIRS. IT WILL ALWAYS BE AT THE EXPENSE OF THE PERSON WITH LESS RANK OR POSITION.

Catherine, First of all, I am sorry to hear that you lost your job. On the surface it appears as a wrongful termination. If you are in an at will state, you can be terminated for what seems to be trivial. However, it comes down to documentation by you and your former employer. In this situation you will need to prove the firing was a violation of your rights, which is difficult. However, it is not impossible. The employer will need to have just cause to termination, even in at will states. Likewise, you will need to prove why the firing was unfair. A paper trail, like past positive performance evaluations could go a long way in court. Likewise, when it gets to court, the employer will need to counter your claim. My suggestion is to get a good labor attorney and run it through him/her ad they will know the laws in your state and advise you accordingly. Unfortunately there are employers out there that don’t play fair. A good attorney will help level the playing field. Good luck.

My experience has been in MN, if you are fired, they can't deny your unemployment benefits. If you were to resign, as I did, I was not allowed benefits, even through two appeals! J

I had to leave the job for two reasons: 1. The job was to far and I wasnt making enough money to keep transporting back and forth to work. And the second reason is that I had to leave because my mother fell ill. I had to stay home take care of her.

It shouldn’t matter the state or the situation. Complaints are supposed to be allowed and the fact that your supervisor was fired says your complaint was justifiable. You getting fired should have been grounds for a major lawsuit from you... this is a horrible behavioral response from your employer and NOT an employer you want to stay with but a lawsuit would show them they should not behave this way... you did nothing wrong (presumably) and now you’re jobless AND UE less... not right

Worked over 5 yrs for a condo complex. Security guard. General manager out of no where places a paper in front of me and explained I had 3 offenses against me. Attendence, out of radio contact for long periods of time, breaking rules by allowing food ( pizza) in a media room. Bottom line any of these offenses happen again, i am terminated. Rules for renters are different than for homeowners, a leak occurred in a rental unit. As a security guard, condo rule for renter is call agency and report. Because i had an offense of bending rules and signed it and received a copy, i was bound not to check it out. I was fired because of this. And come to find out, my name was never mentioned in the so called problem in the media room. Homeowner came forth and told i was never involved. General Manager sent me a letter that he was taking that charge off against me. If he would have not barred me from bending the rules, i would have immediately checked out the leak. But they fired me anyway.

Sorry to hear that Catherine, policy in companies are supposedly set on place to first protect the company and, then the victim but, if HR feels the company is still at risk in any way they will likely clean house. Even though you followed protocal it still feels like you were kicked to the curb for doing the right thing it's cold hearted. They have left you no choice but to fight for your rights. They could have handled it better using mediation between you and the company preserving your position. Lawyer-up Catherine you deserve fair treatment and you will need to fight for it.
