
Relocated for a job
My current employer assisted me with relocation (from one state to another - 1000miles) by providing 1500.00 (which was taxed) upon signing my contract for employment. I accepted this job because I was informed that this position would allow me an opportunity to obtain a certification within a year (paid by the employer), which would provide a significant pay increase. In addition, upon completing the program, I would have to agree to work for the company at least two additional years. I agreed. However, I have relocated (residing with someone), but my employer came to me two weeks ago and stated that I had 6 weeks to move to a specific area (indicated on my contract) or I would be out of the program and I would have to take another hourly rate (which averages 10.00 per hour) position, with lower pay, if I did not agree to move. The program manager stated that they are not willing to pay me mileage if I do not move to this area. I indicated that I would commute and I would not bill for mileage, but rather accept the 250.00 stipend for travel, which is an option offered through the program. (The area is 60 miles from where I am currently residing).
My contract states I am to provide services to a specific area (county) and surrounding areas. It does not indicate that I must move to the exact city by a certain date. I explained to my employer that I was willing to move to a surrounding area, but I am not willing to move to the city (county) they are suggesting. My employer informed me that I will need to pay them back the 1500.00 (even though it was taxed) and I would not be provided mileage since I am not moving to the specific city. My employer stated, I can keep the 1500.00 if I move to this specific city.
I have relocated over 1000 miles. 1100 (did not receive whole 1500.00 does not cover all moving expenses.
I need some advice. Am I obligated to pay back this 1500? I also feel upset and disappointed because I would not have relocated over 1000 miles for the position, I would have to accept if I do not agree to their terms. I explained that I am a licensed professional with a master's degree. I am not above working in a position that requires a high school diploma, I tried to explain that I jjust would not have relocated over 1000 miles for the alternative position. I am also 10-12 hours away from my children. I accepted this move because I had been unemployed / under employed and I needed to opportunity for financial stability. My children are residing with there father.

Hi Tina John - I'm not sure that we can assist you with this. It sounds like you signed a contract that had certain stipulations that were dependent on you locating to a specific location,
I would seriously consider seeking a lawyer in your area who specializes in contract law, as that is going to be the only way that you find out for sure whether or not you or the employer is in the wrong, At the end of the day, someone with expertise is going to have to read the length of the contract and decide what your available courses of action are.
