
Is it legal?
I recently applied for a position had a phone interview, yeah. A few day prior to the interview I was sent a link which asked for my date of birth. I completed honestly. When I got to the interview I was told the position was filled the prior day. I am 60 and a very young 60 with many years of experience. This is a major dept store. I smell ageism. Any thoughts.

Age discrimination is real. After a 35-year stellar career, my position as a Director of HR ended at age 65. I had hoped to work a few more years. I have made it to the final interview for several positions, however, have not received an offer. I can almost guarantee they are looking for someone much younger who (they think) will be with the company for the long term.

I have been in the same situation and nicely and with a smile explain with all the identity theft out there, I prefer not to give my ss# or date of birth unless there is a job offer. That seems to work, and people are very understanding about that.

They dont want to hire older people because they know we are a lot smarter than they are.

I took my first two jobs off my resume which made me appear to be 15 years younger from 55 to 40. I got five phone interviews in a two week period and all went great. However all of them found out my age through the application process and I never heard a peep from any of them afterwards. Phone messages were not returned and emails went unanswered. I returned to putting my entire work history back on my resume.

Ask someone young to apply for the SAME job themselves, acting, to go through the motions and see if the job is filled or not. Go for the interview.
Document copiously, with video of forms online, separately record the phone interview (separate, in case it is not allowed to be submitted - but EEOC should not care).
In my case it does not matter if they discriminate my age, then they are the losers of my experience, that can make them most often 100's of times what they pay me. I was getting ... for example ... 160 K with my employer and on contract - I showed Chevron how to make $1.23 "B"illion more per year from WHAT "I" showed them - they and their SME's - subject matter experts - had NO idea! I wish I had said "if I show you something worth your while, you have to give me 1%" of the extra I show you !!! Right now I am in the same boat as you, but God keeps bread on the table for me.
Ageism is sickening, but we should not despair on their account of such a "sin". God is perfect, and He has some other purpose for us - He never abandons his flock. Whether we know it or not! So, the other course is forgive, forget and move on to another adventure in life. I know THAT can be hard - from experience!

Catherine I fully understand. Yes it's illegal. One of things I have found that employers get around it is that you have too much experience and they think that you won't accept the salary because it's too low. I'm retired on disability and 56. I fully capable of doing any job that pays minimum wage, but I retired from a job I was making $18.00 an hour. I just need enough to supplement my monthly disability retirement check. I have found that I'll get a job now and the company treats its older workers like crap. They seem to think that the 20 yr olds are their future (this was Walmart). So they gripe at the meetings about attendance and it's only the older workers there. We are the ones there every day. We work hard getting the job done, while the 20 yr olds are off talking on the cellphone or talking to their boyfriend/girlfriend in another dept. and when one quits they all quit. They want better jobs and pay. They don't stay with a company for yrs.
The best advice I have is to work with a temp agency. I don't have to deal with a company that acts like the older worker isn't better. I can decide if I want to work with company or ask for a reassignment thru the agency.
I do want to ask has anyone had reverse age discrimination. In my early 30 I trained to be a home health aide. I applied to retirement center that I knew of thru my aunt. They asked where I got my training and called them the next day. They hired a friend who was 20 yes older. Both of us just finished our training (at the same time) and she had no more experience than I had. They didn't even really interview me. They asked a couple of question and then asked where I trained. So unfortunately ageism can go both ways. We just see more in the older work force.

Great question ! It is not illegal to ask your age on a job application.. BUT.. GET THIS.. you cannot be discriminated against against over 40( everyone wants to hire that up to 40 bit! ) it use to be on job apps they did need to know legally if people were over 18. My point is.. how can we ever prove that we are being discriminated against because of our age ? We can't. ...and they also find out put by running our background checks. We are in a pickle. I started writing so I can stay away from job search. It is a great way to be out of the stress. If you think you might like to try.. do it! I'm working on short stories for a book.
Thank You for your encouragement, I needed that. 40yrs experience and they want young n cheap that don't care and show up when they want and I'm in Medical field. I believe in patient first,not myself.
