
367 days no day off
I am a GM of a restaurant. I have worked 367 days from 8:30 am to 8 pm due to staffing and not having managers to hold accountable. Is this legal? Due to exhaustion things began to spiral down and I couldn't keep up and now have been terminated and surprise they found a GM to come and help. Please advise

You must have been good at what you do - too easy for them to just let you keep on keeping on. Were you the hiring manager for the absent managers - there is a discrepancy gap there, for sure. I do not know how much you want to spend any time fighting this. If they do not sign on for unemployment at least, it sounds worth a visit to a person way higher up on the chain of command. You probably were not paid out for vacation hours, either. Gather information about where your experience could take you, take a month to rest and get your health back and...Next!!

If it's not a private restraunt I would go to corporate and fight the termination and put in a grievance...it's private then maybe better business bureau?

Absolutely a department of labor matter. Even if they say that you are salaried they can't use that to get double time out of you without compensation. You don't need a lawyer. The department will make a decision and fine them for lack of overtime payments and pay it to you. Go for it!!

You need help. I think that some think that workers are like robots. That is awful. Could you hire another? An employee and make them a supervisor or assistant manager to take some of the load off and business will continue as usual? I find it best to hire within the ranks because he or she knows the operations of the work place.

Oh god Alison, that sounds awful! I'm so sorry this happened to you. My brother is a manager at a restaurant and he works insane hours as well. Would you want to work for another restaurant? Maybe one that prioritizes employee health more? Let us know how the community can help!
Wow, that is incredible... First that you actually were able to go through such a grueling year and second that your employer took advantage of you for so long. I think it says a lot about your character and work ethic, which are incredibly impressive! I agree with some of the others who suggested seeking legal assistance. It is in no way OK to push an employee past exhaustion in such a way. I wish you all the successes!
