Legal advice

I'm in major need of legal advice regarding harassment and bullying in a workplace! I can't go to HR for the fact that it is HR that's the problem.

I'm so sorry, you know, I have dealt with and seen similar situations. One company that I worked for... if you called HR about a manager, all they're going to do, is tell the manager, what the employee, said, and give the manager, your name, and tell him, to handle the situation. That's what they told me, so, I was like, how does that help? I thought there was actually somebody that was "on my team," if I was having problems, with the manager, but that was not so... that wasn't the case... they said, they would just repeat, tattle tale, the information, to your manager, and I was like, I could have done that myself. Lol. I already know, he's the problem, and district manager, didn't want to do anything, either. They don't care. They only cared about numbers, and not how the manager was treating the employee. He ended up getting fired because he was being "passive aggressive" to me. He was "stealing" sales from me. This was a commission based company. I would make a sale and he would re-ring it up, in his name, thus, stealing a sale. He transferred me to another store... also to be passive aggressive... because this store didn't make as much money... as the one I was in... but I was glad to go... not to deal with him. He continued to steal sales from me, while I worked at another store, and I caught him, and re-rung up the sale in my name, and he called me on the phone, and threatened, me, and when we ended the call, I already knew, what he was going to do. Which is "exactly" what he did... Christmas time rolls around and I'm still at this other store, that he transfers me to, and he calls the manager, and manipulates, and says, he wants me back. Remember, I was his employee first! He transferred me to punish me. But I was his best employee sales wise. He calls the manager. Says he wants me back. Only to try to get me fired! He would be passive aggressive and say that he was going to hold a Saturday morning meeting only to call everyone but me and cancel the meeting. He did this on numerous occasions. So, I climb out of bed, to go to a Saturday morning meeting at 8 a.m. when I'm not scheduled to be there until 4 p.m. (another passive aggressive move). All the Saturday sales were mostly in the mornings. So, he would schedule me later in the day. 4 p.m. He knew that since everybody comes in the mornings on Saturday and buys that those would be easy sales for the not so good employees and even when it was slow I could still make sales. So, he scheduled me in the afternoon. I would have made more money if I were scheduled to be there in the mornings. Anyway, with his Saturday morning meetings fiasco to be passive aggressive. He left the door open on the front of the store. I came in and it set the alarm off. I had to call and report it. I'm not sure how they handled it, but he wasn't working there for too long, after wards. But in order for them to not be able to question me, he didn't fire me, and I didn't quit, but he took me off the schedule, completely, to punish me, and said, that I would have to call or come to the store and check to see if I was put back on the schedule. He took me off the schedule until..... Well, two weeks passed, and there was no change, and my friend told me, that if you lose your job and they didn't fire you and you didn't quit, you can draw unemployment. I was like, okay, that's money, that I paid, into the system. And so, I took that opportunity, and well... to be honest, he was withholding my vacation time, because I had 4 weeks vacation time, accumulated, and every time, I tried to schedule my vacation time, which is paid vacation time, he denied it, every time, and another thing, he would hold my checks, when I got paid, because instead of doing direct deposit, I was doing the checks, because I liked keeping up with my pay stubs. So, yes, he was doing all of this... And another thing, when I won prizes, because like I said, I was good, at my job, and when I won prizes, at work, he would hold the prizes, in the backroom, and hide them, from me, and it would be like, 2 months, before, I got them, and oh, they were there, and everybody that I worked with, saw them, and had asked, me about them, like where is your prize? Did you get your prize, yet? I'm not going to harass you, for some prize, because if you don't give it to me, I'm going to report you! So, I wasn't worried about it. He's either going to give it to me, or get reported, and I kept up, with every paycheck, because I kept my pay stubs, so, I would know, if he was not giving me, one of my paychecks, because they were all numbered, and in order, in a folder that I was keeping at home. Narcissistic and Passive Aggressive was what this manager was with Entitlement Issues because he would steal sales and then, using power and control, for his position as a manager, and my personality, not to stand up to him, and say anything, to bully me, because I would do something, if he didn't give me my prize, or money, but I just didn't see the point, in telling him what he already knows he is doing wrong!

Hi Kristian: I'm so sorry you're going through this right now. I say find an employment lawyer in your area who offers free consultations. It's a great way to determine if you have a case, at which point you can decide on whether or not to move forward. I would also start trying to find another job - you don't need to stay in a toxic environment like that!
