
Upper management made a mistake
I started working for a company two days before New Year's. A few days prior to me starting work the manager of the location I work at called me personally, even though I applied at a different location and ask if I want to come and work for him add his location. He told me that the hourly wage was higher and I could make more money there. So I went in for an interview and got the job on the spot. Like I said my first day was two days before New Year's. After I started working there I started asking my manager about my paycheck stubs and how to access them online and what was the location code that I needed to access my paycheck stubs that I am now only available online. My manager told me multiple times that he would forward me the information which never happened. At one point he even asked me why do I need it. Not that it was any of his business but I need it them for proof of income to be able to rent a house. About 5 months go by and I still keep on asking the whole time, but still no information. And then one day my coworker hands me a piece of paper with the location number that I needed so I went online and set up an account and look over my paycheck stubs. And my jaw dropped! I found out that through that entire time and countless hours of overtime ( that I was promised when I was hired and now my boss is going back on fat as well but that's a different story) I was getting paid a lower wage hourly the one for the location that I applied for. My manager used his bosses code to get into that applications and pulled mine out of I don't know how many, and then they screwed up the paperwork saying that I was employed I'd occasion that I applied for not the one I work at. it was a Sunday when I realized that so I texted him and ask why that was the case with a snapshot of my paycheck stub and his answer was that he doesn't know he just puts in the payroll. Well I know for a fact that he does not put in the payroll, his assistants do. So I went to his boss and told her what was going on. well long story short now the company owes me roughly anywhere between $ 4,500 to $5,000, and they're trying to tell me that I should have realized this earlier without having access to my paycheck stubs and I didn't get a W-2 for the 2 days I worked and I didn't get a W-2 for the 2 days I worked before the new year. When I said something they raise my wage instantly. And back paid me for that entire pay period, and the one prior to that one. I know of other people have company that were not they correctly used and they got their back pay but because mine is so much they're fighting me. I tried to reach out every few days to my managers boss to find out what the progress is and I either don't get a response or I get a very big one that she will find out and get back to me. The last one was 2 days ago she told me she was having a meeting with her boss and she was going to ask. well I'm still waiting for a response from her, again. Everybody's in the company knows about it; from HR, to payroll,as well as the vice president, and director of operations. I'm trying to be nice about this because I actually really enjoy working there. But how in the world can a company take this long to pay somebody back when nobody is disputing what I am saying, my manager is not disputing or saying that I'm not saying the truth. Especially a company that spends over many different states and has well over hundred seventy locations or or something along that line. I just want what belongs to me and I don't want to fight about it. I just want them to do the right thing like they have done before with other employees and pay me back what belongs to me even if it has to be in installments over time a few pay periods. How do I get them to get back to me, how do I find out what's going on if nobody's telling me anything? Or do I have to start getting loud and obnoxious about it. if anybody's got any advice. I would love to hear it. Sorry about the post being so long.

Wow you got a case here in my eyes , I bet if you have been a little bit disrespectful they would have helped you quicker and treated you with the respect and cash you demanded ... How dispicable.....What a terrible thing to do to someone....I would contact the BBB....It's illegal what they r doing....Obviously u have to watch ur own back cuz clearly no one else is..... Unfortunately it's the world we live in but u still have to abide by the laws regardless.....

HI Katarzyna, of what you have told us, I would say that they are probably trying to figure out a way to pay you, of coarse this is just a guess, and definitely would be the right thing to do!. Most companies, have internal controls preventing large payments for obvious reasons, not only when it comes to payroll, but also accounts payable. The good thing as I see it, they increased your pay as soon as you brought it to their attention. Honestly, something like this, they could have easily said that you were mistaken and they owe you nothing. I would suggest to have some patience, not sure how long it has been, but give another couple of weeks. Getting loud and obnoxious about the situation will do no one any good. You are much better off handling this as exactly what it is, a business transaction. Again, make it perfectly clear that you are owed the money, and that is not going to just go away. i would suggest you remember the reality of it. Most companies dislike it when an employee makes waves, not saying you don't have rights, and that they are wrong, just saying, the more difficult you make it for them, entirely possible they do the same for you. So, depending on how much you need the job, seriously consider any action that you intend to take, before taking it. Look at some of the ramifications, what might transpire from your actions. And as for actions, do you have any evidence in writing stating what the rate was that you were hired at? If not, any legal action would be an uphill battle. Best wishes and keep us posted.

go to the labor board and explain what happens and show them the papers as proof.... and if they let you go because of this you can legally bring suit against them.... that's why I work as an independant business owner with none of the headaches....

This sounds like an issue for the Department of Labor to address.

Sorry to read about your woes. But do not scream and get indignant, there are agencies in place to review your situation. Let your HR department know in writing (an send same to yourself), that you will be taking this matter up with the labor board. First do your research on the labor board in the jurisdiction of where you are and wait 3 days and see how your company resolves the issue. If no resolution, press forward to labor board. Best to you.

Agree with woosely go to DOL and get on record then continue to fight. If they try to terminate after you have been to DOL-lawsuit. As long as you do your job the DOL is your job security.

As many on this forum has stated, you need written documentation of this matter to prevail against your company and get all of your money...Now, they will start documenting everything about you in the workplace with hopes of finding something to terminate you on...At last, still go to both the Labor Board and EEOC to get this all on record.
