
Fired because of FMLA
Fired because of FMLA the company refused to let me use my FMLA WHEN I call them and use a day that I miss because of a on the job injury. Company knew that I had a drs appointment with there doctor. Company said that I had 14 points when I had only 5.Can't get Union to go any further with geaven,s . Had to fight for unemployment benefits I won. Filed a complaint with the NATIONAL LABOR RELATIONS BOARD THAT'S ITS SO FAR. JAMES

Sounds like everyone has a different opinion and or view about FMLA. The best thing for you to do is take your paper work and whatever other supporting documents you have and seek legal counsel. There are plenty of lawyers that will give a free consultation as to whether you actually have a case or not and will know if there are in loop holes that can either work for you or against you. Everybody has opinions and there are two sides to every story. On this board we are getting your side only where as legal counsel will have access to your side and the employer's to see if they were actually in the wrong.

James if you won over unemployment that means you have a legal case against that employer, just find an attorney who handles discrimination cases which this situation falls under, you'll probably have to come up with a retainers fee. And stick to your guns Bud !!

Who has more credibility? The guy who can barely articulate a sentence or the corporation with a million dollar legal team with lots of signed documentation and that knows exactly what the corporation can do and what it can't? No way is the corporation going to act emotionally and risk losing a lawsuit. Sorry pal, unless some corporate dork made a huge mistake, you're probably SOL. Move on.

Get an attorney to go after your employer for denying your FMLA., which is Federal Law (make sure that you have medical validation from your medical support for your attorney. Also, have available any documentation that acknowledges your condition and when it was reported and acknowledged by management and the medical dept./staff of your employer. Also review the grievance process, so you have representation when management comes a knocking, looking to stick it to you. Good luck. Nate D.
