Fired Defamation of Character

I recently was hired on with company as Production Manager. I was so excited until I started and found out the mess they were in but I observed and by my lunch break on my first day I knew how to fix it. So I went to the owner told him what needed to be done and he said he was on board but his actions told otherwise. When I started all of the people in that department were either let go or quit and the customers were livid. I admit I had some trouble staffing my department but that's with any company. It's hard to find qualified people that are a good fit. The reason none of the people before me were there is because they had been telling lies to customers and weren't qualified. They had caused the issues that the company was facing with irate customers who had contracted for either an addition, remodel or sunroom and had paid all but a few hundred dollars on their contracts but only had holes dug up in their yards. So this is what they were doing when I started they would sell a job and get a deposit he (owner) would then get them on the schedule ahead of other open jobs and go out dig either pier holes or footings and then leave it for months. He has unfinished jobs from beginning of 2016 that to date aren't finished but are paid in full. The quality of workmanship is more than sub par.

When I started I told him he needed to stop selling new jobs, he needed to stop starting sold jobs and he needed to go by contract date and finish up all his open work. If that meant getting a line of credit or taking on investors it needed to be done before he got sued. He didn't listen and continued to sell work that he didn't have personnel that could do that work. Even the jobs that had financing he would submit and get all the funding off the loan and that customers job wasn't even started. Customers were paying payments on loans that services hadn't even been completed on. I worked there no more than 6 - 8 weeks. I worked Monday - Saturday 6 am until typically 7pm sometimes 9pm. I was not reimbursed for fuel, filing cabinet or any of my personal belongings when let go.

Then I had a friend tell me that someone in their family had called The company out for a bid on a sunroom and asked them about the recent news story on them and the salesman gave my name and blamed it all on me. First of all I wasn't there long enough to cause the troubles the company is in and second of all I am NOT the reason for the news story. I did my best but the owner and other managers just wouldn't listen and do what was necessary to fix it. I want to know what I can do about this slander. Yes they are called tipping laws. Look them up. Find your state laws regarding public relations policies in the companies handbook online.

It sounds like an illegal Ponzi scheme they are trying to cover up. I believe the company can be charged with a felony. If true, it would help your defense.

Get the facts including the particulars on the news story. Account for your time and whereabouts relating to the incident(s) covered in the news story relating to this company. If your advise was in writing secure copies. Any factual documentation including dates times and details would be helpful. Any interoffice communication regarding your suggestions, input would help. Documentation of your time and whereabouts would be very helpful. If as you said is true, documentation will be vital. if not proving "he said, she said" becomes difficult to prove.

Hello Kelly I am so sorry about your loss I recently was fired for false statements made against me I did retain an attorney but come to realize that since I reside here in Texas (It is a at will State) that means other then Age, Race or Sexual Discrimination then it would be difficult to prove I also had paper work I written down everything that happen to me and had witness but still the Attorney wouldn't take the case, however he did say he would take the case if I applied for Unemployment benefits and they refused to pay then he would be there and speak for the Appeal for a small fee of $500.00 but Good luck to you and I hope you pursue this and win. Pray and ask God to give you wisdom and favor.

You should contact your Better Business Bureau then follow up with the news agency who wrote the story. Also for future reference you need to keep detail records and facts you knew you were coming into the bad situation and you should have set yourself up to protect your reputation and your career.. They we're doing shady business practices before you joined the company. They had unfinished jobs on the books all dating back to 2016. That should have been a red flag immediately and I definitely would have questioned the company ethics. You can turn this all around to your favor just by letting people know the truth so you have to get out there fight it and let them know what type of company this really is. If they are doing that bad on jobs selected, talk to your manager of labor.

You are on the right path, seems like the job is a scam, it is not producing work cause it is not there to build a business it is there to rob people, they might try a claim bankruptcy thinking they can get off so I suggest that you get a free consultation from any law firm and see what your options are and get the ball rolling before they realize what you are doing, I am sure other people who worked there went through the same and done nothing about it ,I am glad you are standing up for yourself. Once again Missing information . What was reason for termination? talking to the press in most companies is reason for termination. see company handbook, what Slander is going on about you? so on your very first day on your lunch break you figured out how to fix a company problem? HUMMM really? It takes longer then that to see and fix issues ! once again to much information is left out.You claim you did not call the press so nO you are not protected by whistle blower laws. If company is doing what you say then they are committing fraud. and that is something you local district attorney has to deal with. and NEVER say a friend told me! stick with facts not hearsay.
