
Former employer possibly interfering with new job opportunities.
A bit of backstory to this, I was terminated from my position about 2 months ago. I was the in charge of a small department that could barley keep employees around for more than 2 months at a time. There had been a manager change a few months before my termination, and the new manager did almost everything in their power to have me removed from my position. With my job position, i was supposed to train all the new staff members that we would be receiving, but she would never allow or schedule me to train them, always having someone with less experience do it, and whatever issues that she had with how they were trained was taken out on me. The person above her was absolutely useless whenever i brought up these issues, and it always seemed to get worse. Almost ever day for months at a time, she had some different issue with me, and even other employees were starting to notice that she obviously had ulterior motives to her actions. Around September we started having issues with another employee, she had begun to bully him as well, and i'd be called into her office almost daily and threatened that he would be terminated if i couldn't turn the situation around. I had brought this issue up with my equal, (there was a mens and womens side) and even she agreed that he was not at fault. Towards the end of my time with this company, we brought on a new team member who came highly recommended from a sister location, but it turned out that he was next to useless, as when left alone he would do no work, and the workzone would be trashed. He received all of the praise for others work, however. Following this, my set schedule that i as the one in charge was supposed to have was changed,i would be opening the location instead of coming in early afternoon and overseeing operations until night. This lasted 3 months, until we hired on an extra employee, which i was actually allowed to train. On his first day i had asked him what position he had applied for, just to make small talk while i was showing him proper procedure, and he told me that he was getting my job. I brushed it off and continue to train him until i decided to inquire with my manager two days later. She went on a tangent for about twenty minutes about how all the staff that was on my side was inept at doing their job,even though she had only hired on 2 people, and not a single person in the building had any issues with how my staff performed their duties when the old manager was in charge. She even began to insult one of my staff members, referring to him as human garbage, an absolute disgrace to the team. Again, no one had any issues with this employee, ever. I had gone to HR about this meeting to file a complaint, as was outlined in our handbook. And the next day,instead of investigating it, they had emailed her a copy of my complaint and i was terminated. I was not allowed a copy of the paper that i signed( although im not sure if employers have to give you a copy of it) and i was then escorted out of the building. Since then i have had the absolute worst luck with finding a new job. I have had about 15 or so interviews, all of which the interviewers have said i am more than qualified for the position, but i never hear back from any of them afterwards. Whenever a potential employer calls my former place of work, it seems to derail the process entirely. When i had first started there, almost all of the employees there, as well as my first manager, used to talk about how if you are fired, the company makes it incredibly difficult for you to move on and get a new job. That they would say anything to keep you from being hired. I kept in touch with one of the men i trained from before the new woman took over, he had quit earlier due to what had happened to me first happened to him,and he told me that it had taken him almost 6 months to get a new job, and that the company would do nothing but bad mouth him as an employee. I speak with one of my former staff members weekly, and he even says it himself, that i am brought up almost daily by the management, by people who never had any issues with me before this woman took over. I'm the running joke in the office space now. I should have no reason to believe this nonsense, but unfortunately i do a little. I had tried to receive unemployment but the management had lied about my reason for termination. At this point, i don't know what i am supposed to do. I feel i was pushed out of a very good job because my manager refused to ever take me seriously because i was young. I'm not sure what i can do.
There are many reasons that leads to things going sideways at a job. Management changes or changes in leadership are usually at the top of the list. Sounds like you tried to do all you could to remedy the situation and relationship with your boss but the ultimate decision is her’s. At-will employment empowers employers to end working relationships with no notice. Moving on… if those 15 hot interviews are turning cold then that’s enough of a reason to believe that something during the background and reference check may be triggering the sudden loss of interest. In a perfect world companies are only required to verify employment (dates, positions held, length of employment, etc.) adding no personal comments but unfortunately that’s not the world we live in. Options:
Be open and upfront during the interviews. You’ve heard this one before right! Briefly describe the situation without demeaning or throwing anyone under the bus. Talk about how you made attempts to rectify the situation but in the end the solution was to separate from that employer. This is probably going to be the only opportunity you will get to make your case before the reference calls go out and the potential employer starts eliminating potential hires so make it count.
This is a tricky one but have someone you know call the company for a referral. There are real companies you can hire to this by the way. I’m not sure what they charge but you can check online. Find out exactly what their saying and most importantly verify if it’s legal.
Draft a cease and desist letter addressed to someone high up in the company and call out the person providing the damaging referral and suggest that they only provide employment verification details (dates, positions, etc.).
It’s a stressful situation to be in but make sure you get all the facts before you act out on anything. Bad referrals are common but people still end up getting hired. Make sure there’s nothing in your background that affecting your chances to find a new job.
