A recruiter asked my age during an interview

I had a recruiter find my resume from a job site, contact me about a position in tech support/client management with a large company that seemed to be an excellent fit. The call went really well, with her asking for my availability in the following week for more interviews with the company's hiring manager. All good. Then just before the call ended she said she had one more question, this coming directly from the company - what is my date of birth. (I'm an older worker with 19 years experience in tech). though she had previously said she would set up call meetings for the following week by EOD, I never heard from her again., and it's been 4 days now. this sounds like pretty blatant age discrimination. I'm in California, Silicon Valley.

I spoke with a HR Specialist and she says they can not ask for a birth date or the year you graduated. Her company had to redo all their hiring paperwork. Tell them they can not ask those questions. She suggested to keep track of who is asking and turn them in to the labor board!

You should have asked why she needed that. You could consider filing a complaint against them. And you're complaint you would let them know that you did not hear from them anymore after she asked you your date of birth. It may not be the re

You could also call and follow-up to ask what the status of it is of the position and or you could just wait for a few more days to see if they call. They may not have completed the process yet, may still be interviewing other candidates. You can also be another reason that you haven't gotten a call back but it does give me impression that it's possible because they asked i at all then they asked it when they did. Maybe they just had something else that came up that's prevented them from making a decision as soon as they intended.. the ball's in your court now so what are you going to do with it?

I thought that was illegal for them to ask that question because of age discrimination.

I know that it is illegal but while completing an online application, it asked for my date of birth and had it marked as mandatory field. I refused to complete the application, but who do you report this to when you find it?

It is against the law to ask your age, however, this is extremely difficult to prove.

Tell her your age is on your resume. You don't need to put your actual DOB on the resume. Just put the year you graduated from High School. They should be able to figure it out from there. When you fill out the job application they can legally ask for you DOB. Good luck
