Discrimination

I've recently been working for my current employer for about 5 months now and this last month I was out of work for no reason at all! My boss didn't believe that I am OK cause I had a back surgery in 2012 anyways I gave her records from 2 years ago that stated I have no limitations or restrictions. She didn't accept them cause they were "current" and I couldn't go back to work till I got more recent ones. So I did and when I brought them back she started judging me for my anxiety. I have been diagnosed with general and social anxiety so it is hard for me to interact with coworkers and clients when I tried to explain this to her she got really rude and was like "well that's not my fault either you change or you won't be working here for much longer." Also she said "I'll give you a second chance but It will be a short period of time" like she purposely is trying to get me to quit or give her a reason to fire me. I don't know how to go about this I am currently looking for a new job so that's one way.

Let me understand this correctly you were out of work for no reason at all? If you're doing your job correctly your boss should have no complaint where does the Discrimination come in at?

Brandon,

It would be worth checking into UALD and the EEOC. They will review and rule out, consider, charges based on discrimination. You will have to look each of them up online as to how to file. I hope this assists you. Keep your chin up....where one door closes another one opens.

Hi Brandon. I am so sorry that you are going through this. It is burden because you know that it is not you. I have gone through two law suits with EEOC and it is time consuming, stressful and you have to be willing to see it through. I am not trying to discourage you but it is a tedious process. This lady is not going to change. No matter what you do. However, I suggest that perhaps you decide if this is a battle or war. Meaning, do what you are doing and don't give her your energy and power. Continue to take control of the situation and DO NOT use her as a reference. Good luck and this too shall pass.

You no, I feel a lot of people go into a lawsuit mode out of anger or hurt because of how they feel they were treated. I understand that hurt. But lawsuits are not always the answers to your pain. Long term, this will and can effect your future from finding a job. In spite of a person's wrongness people really have to learn how to forgive and move forward or count up the cost when u do set out to get someone even when they are wrong. God is there, but the understanding of how he is there for u needs to be understood. We must count up the cost if we choose to fight as the world does. Not every one person represents the entire body the entire company, and sometimes u must remember this when dealing with one person and not the entire company. Lawsuits can be necessary, but that's what the EEOC, or whatever is for Go by chain of command. let people right their wrongs first. Learn how to forgive your enemies. Because after the lawsuit is done your pain is still there. I have been on a job to where I was recording conversation, because I was being treated so wrong. Being followed it was so bad, my coworkers were coming up warning me. I was so stressed out. If u knew me, I am a fighter I don't back down from nothing and this issue wore me down. I forgave him I actually could have had a lawsuit, but it's not worth it. I prayed about it and before I left that company he was demoted from supervisor. God takes care of his own. We have to learn to forgive one another and move forward into the glory God has for u, and allow God to be God. No I didn't pray God destroy him, but God knew how to deal with him without hurting him because I didn't want him to hurt I just wanted it to stop. Sorry was not planning on speaking like this, but lol. No I'm not a preacher, no I'm not a fanatic Christian. I'm a mom a grandmother and I have a temper and I slip and curse and I over eat just like all I have weaknesses too, but I also believe in people and give chance because I want a chance if I mess up or fall short. Boy, do I fall short. Pray ask God should u stay or should u go. If u are a fighter, fight for your job no one is going to just give it to u. Stand tall stand strong and with God you will Concord the weakness that's trying to still what God has for u success.

My name is Emma Garcia Ocampo and i was in the military and i was treated the same way but then i shower them who the boss was and now they have respect for me and now that they under stand whats going on they told me after i had My first heart attack that i was not going to get my pensión so i had went to My captan and told them what happens they told me that the company was going to deal with it and so they changed the attitude and that sence i am a seniorMaster sargent that i was intitled to My Benifets and that if they were to way something to me that all i had to do was fire them

File a complaint with EEOC under the ADA. Employers have to give reasonable accommodations for your medical issue. Sounds like your employer isn't giving you any.

Your issue here is whether you can perform the primary functions of the position, and whether there is a reasonable accommodation that fits your circumstances. For example, if a person cannot get wet, there is no reasonable accommodation available for them to function as a lifeguard.
