Waiting patiently

So, I worked at a company and due to health problems that came up, I was no longer able to do the job that I was currently in. I was told to go through our 3rd party company and request an accommodation which is a transition into another job that would accommodate my health problems. I was granted intermittent leave and it was explained to me that I could miss 2 days per month and not get a point, we are allowed 4 in 6 months and terminated on the 5th. In July when I returned from vacation, I had 4 point that were not there when I left. Some were back from as far as May. I questioned HR and they said it didn’t fall within the guidelines of my leave. I just left it alone. Then I miss 2 days in July and 2 days in August and I got fired for pointing out. I called the 3rd party and they said the only way to get the points removed would be to have my doctor update the form because the way it was worded, the 2 days had to be back to back and not spaced out through the month. So I did this and am now waiting to see if I get my job back or not. I am just very frustrated because if HR had done their job and told me 2 days consecutive not just 2 days that I would have a job right now.

Even though it seems wrong, HR people make mistakes. If they didn’t specify whether the days need to be consecutive, why didn’t you ask for clarity? No matter what, you are responsible for your job; no one else. It sounds emotionless but rule number 1 should always be CYOA (cover your own a$$). Have you gotten any of this information in writing? Do you have names of people you spoke with regarding this concern?

Was this intermittent leave falling under FMLA guidelines? If it was, then they terminated you improperly. FMLA intermittent leave can be taken in very short blocks of time. If not under FMLA, then yes they could do this. But agree they should have given in detail explanation how it worked for their company.

FMLA job protection I don't get points at work as long my time covered the days you had coverage you shouldn't get points as long called in your time reported to your insurance with in guide lines. Hope this helps

I'm so sorry hear that I have intermittent time with my job if wasn't for that I would have lost my job. Every company has wording have follow your doctor must say 8 hours per 1 day 6 times month each day 1 occurance . Pray things work out for you.

I’m not sure I would want to even work there after all of that. Yes fight for what is right but find something else..

I would also contact your doctor and see if they can help in any way especially since they wrote it and you should contact your lawyer and have them check to see if first the writing if done matches and second if under the rights of you and or anyone else who has this if a company has the right to do such a thing and if not make a case against them

HR can make mistakes too. I would see if HR would put it in writing. And that it was not explained to you correctly. Might be worth a try. Hope you get your job back.

Check the American with Disabilities Act. I was fired too for being sick and my lawyer said they cannot do such.
