
A "what would you do" scenario?
Got a job finally in Nov after 9 months unemployed. Thought it was a great, for awhile. Started to realize that the owner is a non-masker and disagrees with everything the who, CDC, and government say to the point of calling the guidelines unconstitutional and started handing out books on the constitution. Also fired an employee for verbally disagreeing with him. Everyday there is ranting about what is going on to the point that I am having a hard time concentrating. Owner also does not pay overtime legally at time and a half but at regular rate. What would you do? Blindly go along and deal with the constant ranting or leave bringing the overtime issue to an authorities attention? #advice

I put in for the last eight weeks straight I need more they took it off and said I couldn't get it and

1-About 1/2 the country doesn’t agree with the CDC and the mask mandate. Just going into a restaurant, airplane or shopping at the mall. We have been fighting the mask battle for almost a year, so make your own decision to wear or not wear… but tread lightly on judging others, especially your boss. 2-you may have already done your homework but just be sure you understand how OT works, when it’s due and and when time and a half is due. I get regular complaints that an employee had 45 or more hours on their check but no Time and a half. Some just don’t understand. If it turns out you are right talk to supervisor. 3-If you are already this unhappy its a bad situation for you and your boss. You should probably start looking for other employment. BUT never let go of one branch until you have another one in your hand. 👍

It does not matter about any of that I'm Idaho I don't know where you live but I was working for a company that did that to me for over a year and I turned them in to the labor board. and they seen were I wasn't getting paid paid. That it was company said it was all my faut it tooth in nail before paying me . After I got to busy to fight them in court

You didn't say what kind of job you have. The whole mask thing is very contentious, it's political, perhaps you are one that wears a mask instead of a MAGA hat so we all know where you stand. But for many customers, the mask is an infringement, therefore bad for business. This will all pass one day, you have to go with your conscience, but at what cost?

Well that's just sad Charlie. And it truly is a dam shame that the working relationship was eroded by personal feelings. So often in life people focus on the ill effects and not the cause that drove it to that point. Charlie ive owned a business for 28 yrs. i'm on my 3rd (and last) company. But i had to come up thru the ranks working for others to gain that knowledge and skill set to go out on my own. So ive been on both sides of that fence. And I tell you now, your both in the wrong and should be ashamed of yourselves. Neither one of you should be so child like as to air your greviences to other's or in front of others on the job. It showed a serious lack of professionalism and leadership skills on his part. spreading discontent and lack of confidence with his own troops. But what does it say about you Charlie as person ? We go to work to feed our kids not be our kids.

These should not even be factors you should consider for staying with an employer. If they disagree with masking procedure it is something they deal with themselves if you are vaccinated this is not an issue for you and has no impact on you. Just like the flu every year there are millions who do not get the shot and wind up fine. It is their responsibility to follow safety procedures not yours and if you get all your shots it should have no impact on you.

I agree. This situation has to be escalated to the Dept. of Labor! I know another scenario. There was a Chinese supermarket in Houston TX got sued over underpaying the employees & no overtime. Yet the market was forced to shut down & ended up compensating the employees.

We are fully remote no mask needed via zoom. Lol we are recruiting for insurance agents. No experience needed!!! We train you while you study for your exam. Full time and part time available.

Hey @Sabrina Martyn , so sorry to hear about all these challenges you're having on your new job. What's so concerning is that these are very serious issues. Safety compliance, during and after pandemic restrictions, is paramount right now. I don't know what the rules are in CA since the restrictions have been listed but it still makes sense for employers to offer employee's the option to wear masks, especially if they haven't been vaccinated.
I don't know how far you're willing to pursue this but these workplace health and safety concerns are typically reported to Occupational Safety and Health Administration, OSHA . Sometimes they go as far as sending out investigators depending on the severity and amount of employees at risk. Again, you need to consider how much you need to keep that job before filing a report because doing so may put your employment status at risk.
For unpaid overtime, you should file a complaint with the Department of Labor. California law requires that employers pay overtime, whether authorized or not, at the rate of one and one-half times the employee's regular rate of pay for all hours worked in excess of eight up to and including 12 hours in any workday, and for the first eight hours of work on the seventh consecutive day of work .

Thank you everyone for your advice. I have updated my resume and have an interview next week. I an also gathering evidence to show that the overtime is not being paid out correctly.
