What is consider EEOC and what is considered At Will?!

I'm confused as to what my fiancee' can do about this situation at his current job. He got a virus that progressed into Pneumonia when he was made to come in the next day he had to work after he called off with a doctor's excuse. The virus was similar to Staph which requires rest. He called in and let the supervisor know that he had a Doctor's excuse but the supervisor urged him to come back to work on his next day of work which was the following day. When he spoke with the supervisor they stated that he had been wrote up and put on probation for a year! He being afraid to lose his job he goes into work despite the rest the Doctor said he needed and ended up getting taken away by ambulance at work. The supervisor later notified him that some of the other supervisors didn't believe he was sick, and that they will still continue to write him up. They eventually approved the second doctor's request for him to have bed rest, but when he returned he worked for about a week and then his building supervisor wrote him up yet again. Telling him he has to be held accountable for his absences despise being gravely ill. We live in a At Will state, but what exactly is considered EEOC? What should he do about this? He's ready to go to another job because of this. Can someone with experience in this field give me some insight?

At Will means they can fire you at any time — that’s what At Will State means. I live in Dallas and it’s the same thing. Really don’t give you no recourse . EEOC IS equal employer opportunity commission— they advocate for you against employers.

He may be covered by the FMLA act. Start emailing, sending certified US mail, etc., so that you can document the facts IF the company terminates his employment in the face of medical advice NOT to work. Also, contact his doctors and have them put in WRITING their recommendations that he NOT work until he's medically OK'd to do so. At-will means that either the employer or the employee may quit work at any time without warning or any need to cite a specific reason. BUT, that is NOT an absolute, again, sickness is involved, so start documenting NOW and maybe that will back off the jerks at his company that are making him work in a hostile workplace.

Hi LaVon Wilkerson ! WOW that is just awful that they would treat your fiancee that way I am so deeply sorry. I also hope he feels better soon. If anyone treated me that way I personally would leave and never look back. I am just not sure how someone could be so heartless! He deserves much more than that crappy job!
