
Drug Testing?
I want to say now that I do not use illegal drugs. I have never used illegal drugs. I almost certainly never will use illegal drugs. Marijuana is legal in my state for recreational use and I still have never used it.
Drug testing as a condition of employment should be illegal. Will I submit to drug test? Yes. Do I believe that it is right for an employer to require a drug test as a condition of employment? No. Without any evidence to back it up, I am required to take a drug test. My prospective employer has no reason to believe that I am taking drugs, but they are requiring me to turn over my blood to them, which, if I WERE taking drugs, would result in incriminating myself. The fifth amendment provides me protection against self-incrimination, and the Constitution as a whole provides protection against unwarrantable searches and seizures. It is completely unconstitutional.
The companies get around this by requiring you to sign an agreement that you will take a drug test prior to officially hiring you. This should not be legal. If they believe I am taking drugs, they're welcome to test me, but unless I seem stoned, drunk, high, or whatever at my job interview, there's no need to test. And if I seem to be such, they probably shouldn't hire me, because if I seem stoned or drunk at a job interview and I am NOT, then I'm going to be a terrible employee.
That said, I am completely willing to take a drug test, because it will show nothing. But it is a violation of my constitutional rights, and employers should not get a free pass to demand that I pass a drug test before they will hire me.
They should make drug tests cost one million dollars a pop. See how many employers demand we take drug tests at that point.

If you have never affiliated yourself with drugs then why have an issue? Why make such a big deal out it? You seem to be knowledgeable with our rights and our constitution and, that is all well and good. Personally, the fact that any employer would ask for a drug screen is a sign of professionalism from them. Example: Greyhound bus is hiring drivers. They dont require a drug screen and have hired an addict. The addict is driving a busload of customers and has a major accident due to his addiction. Greyhound is responsible. This is just an example among many. Moral of the story is: All employers should always drug test. They are paying for it and your drug-free. So take the test ....get the job...and congratulations!!!

Sorry, but I disagree. There are so many reasons that drug testing should be required. I am 48 years old and have tons of stories to why I need my co workers and management sober from all forms of influences. If you cannot pass the test coming in (and you have to cheat to do so) how badly do you need/want the job; excluding prescriptions of course. But if it alters you in a way that affects your job and the safety of you and others... I prefer not to work in those situations again.

I understand where you are coming from in this issue, however companies do this because their insurance companies require it. The malpractice/bonding etc insurers want to offer companies a better rate so they add this requirement into the contract. These companies do not forward the info to law enforcement because they can’t it wouldn’t stand up in court with out a legal chain of custody (at least in New York State). As for the 5th Amendment that applies to testifying in court about a case that may incriminate you in another illegal act.

What you've stated should definitely only include u which u did but not every one thinks like u! Just think, if drug tests weren't administered do u truly know how chatostrophic that could be? Ppl wouldn't get to work on time, people would drive high causiy more accidents and there probably would be more car fatalities. There might be more work violence, more work affairs then more divorces. Then there might be more work accidents! Whew!!! Think about what u r stating! One good person is not enough!

I wouldn't hire an addict and wouldnt want an addict running my business.I think it's ok to drug test.Why not!

It dose not matter like my self I do not like the smell of it and thou I am not in your state I file a safe and economical suit if I smell it in the work place. And it would not matter when I smelled it. I have a legal right not to be forced into not likening something and no one has the legal right to make me be around something I don't like. If I'm wrong then kill me then see where that person that foresee kill me go. I won't be around to know the difference

I hope you don't tell prospective employers this! Almost all companies require drug testing. They do have a right to know you dont use drugs for several reasons. One is to make sure you can perform the job safely. One is to make sure you will be able to perform the job that you are hired to do. I would think you would like to know your co workers are drug free.
That doesn't sounds like John's point. He's simply saying we are protected by law from self incrimination but in all actuality, we are not in the form of drug test. A positive drug test can have resounding effects for years to come in not only not ge6t a job but legal troubles as well as a positive test can lead to a person now be opened up to prosecution.
