City Laborer Worker at The Department Of Homeless Services

Unlawful termination / discrimination

My name is Shad'e Barclift I was a previous female city laborer worker for the Department of Homeless Services Fleet Transportation. I was the only female laborer the rest was men. DHS hired me without a Driver License in July 2015 and allowed me to work for a whole year. After being hired I received my driver license in the beginning of 2016 and everything was fine. A day before my 1year probation period was up they terminated me and didn't give me a reason why. I ask for my personnel copy and they haven't responded to me. My union didn't bother to help or get the answers that I needed to understand why ?? I talked to a couple of attorneys and they reached out to DHS. DHS response was that My mother works in the agency but a whole different unit and they felt I was untruthful with whom I know and because I received my driver license in 2016 and not 2015 . My thing is you hired me without it that is not my mistake that is yours. DHS clearly made a file and took copies of my permit and personnel followed right behind it. So why should I get punished for DHS mistakes. And Let's be honest half the employees there know some one or are related to someone in the agency. So why am I the only one singled out and the only one who got terminated? Is it because I was the only female there who was a laborer worker and did the job correctly. I need answers because it doesn't make sense and something does not seem right .

Please forgive me, whether you're right or wrong - you lost the job. May I ask you take the experience you learned from this job and put it to good use. Unfortunately, the employer already has the upper hand when it comes to firing people - why? They provide jobs. I know its heartbreaking and most likely just not right. But you and I are a needle in a haystack. Take your experience and make the fullest use of what you learned. I assure you soon that knowledge will put you above the rest and land you a better job. If you allow this one job to anger you, you'll lose. take it as a lesson learned - trust me - you'll be more valuable in your future

I know exactly how u are feeling right now. I got a text saying I was being termed from my position that I didn't need to return. Sad truth is that I was being termed for missing work on a Saturday night but did call in which had no choice due to a situation I was having with a co worker I was trying to help out with rides so he didn't make it in either. He didn't even call in that night. I got termed n he still has his job and has missed every other day after that Saturday night . How is it right he keeps his job?

Set an appointment with your nearest EEOC (Equal Employment Opportunity Commission) and discuss your situation with them. They will ask you the right questions to determine if there is "Prima Facie" evidence for them to pursue your case. They will be looking for possible race or gender discrimination. If they think they have a case, let them do all the work for you. WE, those of us who read all these complaints in this forum, never have enough information to make a valid decision. But EEOC will. I think you were correct for getting the lawyers involved just to get answers. If they are like other agencies and actually paid for your license, look at it like they paid for your license, provided you a year of experience and move on for more money. I've been there, done that, and benefitted from it greatly!

Shad'e, Keep up with the attorney and keep on the agency about your case. This sounds like a major error on the part of DHS. Don't let them get away with it. You may not be able to get reinstated but you know you were up front with them. Don't let them put this off on you or claim that you were not truthful about your situation at the time you were hired. It sounds like someone is making you the scapegoat for his or her mistake.

SORRY THAT HAPPENED, BUT MANY TIMES EMPLOYERS DON'T NEED TO GIVE REASONS FOR TERMINATION. I'VE BEEN IN SIMILAR CIRCUMSTANCES. IT MADE ME ANGRY FOR QUITE SOME TIME, BUT WAS THE BEST THING THAT EVER HAPPENED TO ME. I BEGAN A SECOND CAREER ON MY OWN AS A WRITER AND NOVELIST NOW, AND PROUD OF MY NEWLY ACQUIRED ACHIEVEMENTS. DON'T LET THIS ISSUE BOG YOU DOWN OR PREVENT YOU FROM SEEKING EMPLOYMENT ELSEWHERE. BETTER JOBS MAY BE WAITING SOMEWHERE OUT THERE FOR YOU, WALK FORWARD AND DECIDE WHAT REALLY MATTERS IN THIS LIFE.

Probably the best idea at this point is, as you have already contacted a couple of attorneys, follow their legal advice in pursing the matter.

First it depends if you live I'm a no fault state. If so, you can be terminated without cause unless it's discrimination or harrassment. I can't believe your union rep wouldn't help. I would contact the Dept. of Labor and Workforce in your county or state.
