Need help with this, please someone!!

I worked at an apartment complex and the company was in some trouble financially. So, I live in Richmond, Virginia and the day we went home, which was a Thursday, we received a text and an email which stated, I sent an email as well but I wanted to make sure you would receive this. Please be advised that today, June 14th, 2018 we received a court order that immediately remanded ownership of said property to the control of a court appointed receiver. So, in short, we were given just this as notice and it took them about a month to pay our last 32 hours and any vacation pay that was owed. I feel as if we were mistreated and disrespected as far as workers that have been there. Management still owes me $260 which was suppose to be credited to my account. So, is there anything legal I can or should do? There was no severance for us, just regular pay and vacation pay. Is that all we were suppose to get?

Hi Dale, sorry to hear of your situation. If you can show that you are owed money, why certainly there should be something that you can do. I have enclosed a link to the Virginia Dept of Labor and Industry, which shows a link to claim unpaid wages, if that is why you are owed the $260.

You have to call the labor services office in your State & talk to them. Sometimes a company takes 3/4 weeks to give you your final payout due to lag pay when you first started. Keep the email you got & file for unemployment. Lack of work.

It doesn't matter what state you live...if you are owed wages, they have to pay you. Call the employment office and report them.

Va is an at will state. So I am pretty somewhere in your hiring paper work you was told they can let you go anytime and not give you a reason. Now what they can’t do is let you go for your age,sex, color of skin. If that happen the problem with that is if you don’t have up front proof then that’s it. I think I read you got a job with Amazon, praying for continued success and blessing to you

You could try a lawyer but good luck. Unless their assets are sold it will be very difficult. It happened to me twice. Check and make sure they paid your income tax.

Dale,

Severance pay is not a required benefit employers have to provide to their employees. I would suggest reviewing the employee handbook in regards to severance pay. If the handbooks states you should receive severance pay, you may reach out to EEOC/DOL for assistance. If you were laid off apply for unemployment benefits.
