Is it legal for an employer to clock you out everyday for a lunch break even when you didn’t take one or were to busy and didn’t get the opportunity to take one? My employer is clocking me and everyone else that works there in and out everyday for our lunch breaks.

Absolutely not! This is classified as wage theft if you were clocked out, never took your break, and was still working during the break. Contact the Wage and Hour Division.

In Mass you get a half hour for lunch and two 15-minute breaks. lunch unpaid but breaks are on your employer.

I do not know what state you live in. That is the standard for most of the states. You have to check your states law like Janice Reed said.

I would contact your states labor laws and report them!!!!

Then you need to take your break busy or not when clocked out take it that is the employers worry. If you work over 6 hours you have to take a lunch break unless you are salary. Take it.

Yes Sir because I'm working 9:30 to 1:30 i don't mind if I'm going to ash my Boss that I'm going 12 o 13:00 for my Boss never say to me know because he knows me very well Sir so much better in person faces to faces sir thank you so much
