
Terminated after hired on
So i recently landed a job working as inventory control i was really excited about the job since i been off work for 8 weeks after my surgery..so things were starting to look up i got hired immediately went and did a drug test and the very next day began orientation 2nd day on the job i get a call to HR so i go in and was told that my drug test came back positive for marijuana i dont even smoke .. I offered to take another test and told them that they could re test me at any point they wanted but with the business being open for a year and me being a recent hire they let me go...I over heard the HR personnel say they had this issue last year with new hires ...Im wondering why they even hired me in the first place most jobs wont hire you on until your background and drug screen comes back ...


I would advise you to talk to a labor law attorney in your state. I think you have solid grounds for a unlawful termination suit. You could make a bunch of change!!

Then you need to file with EEOC for discrimination and a false positive drug screen.

Valerie, sounds like they really need the people, so they are rushing the hiring process. It's not right, in that many times you are re-tested, and offered counseling if you are already an employee. The drug screen isn't the problem, it's bringing you onboard before having the results of the drug test. Good Luck...

So ive taken another test which shows negative and presented it but there policy is that i can re apply in 6 months which by then ill be with another company..thank you all for the advice and helpful tips

I might immediately pay for own drug test and see if I tested positive at the same lab and another lab. If you come back with a discrepancy you might have grounds to sue.

From Jesse Warner other meds can trigger a positive drug test. If you test positive at work, get another test from a near by clinic the same day. For back up verification.

How would we know why they did this? You need to ask them. We can only speculate.
