HELP! I May Have Lost Interview Because of Something Said from Previous Company

I am working with a recruiter who last week scheduled me for a face-to-face interview for tomorrow following a phone screen with the prospective employer last week. This morning she called me and said that my interview is cancelled, no explanation was given, and she would hear why off line later. My recruiter suspects that someone from my previous company from where I was let go in January for what they called "wasn't the right fit," said something. My previous employer has current employees who used to work for the new prospective employer. I hope this all makes sense. If I lost this interview because of something said by someone at my previous employer, do I have any recourse? Is there something that I can do to still get an interview? I am extremely interested in this position. Right now, I am angry and disappointed. I want this interview if there is any way to salvage it. Can anyone shed some light on this?

If you can Prove negative or derogatory statements were made by a previous employer or their representatives you do have recourse. By law a previous employer can only verify the time periods of your employment. The caller may ask if they would ever rehire you, but even then, they are only allowed to say yes or no. I Do Not know if these guidelines are different by States. In California, if you can prove "when,who and what" you can file charges with the Labor Board. The problem is Proving it. I had a co-worker that had a friend call a previous employer for a reference. The wretch who took the call really laid out a vicious comment. Eventually the employer was sued, the "wretch" was fired. I don't know the financial details but I know it happened.

That is pure discrimination, illegal for a previous employer to do this, VERY unprofessional. I would talk to employment lawyer !!

I am also trying to get back into my field of X-Ray Technologist. I worked faithfully for many years and because I had a negative confrontation with a fill-in Manager at my last medical position, I usually don't add them to my reference list. Too bad, because I worked there for 10 years and got a good raise every year and very good comments from the regular manager. I am 59yrs. old now and I keep trying but I almost feel like giving up and just continue housecleaning, pet-sitting, etc. It is very frustrating. We are good people!! On the plus side I work for myself now and don't have to deal with the office politics and crazy people in the medical offices (I am not talking about the patients).. Good luck, and like me just keep trying.

Hi KathyAnn,

It is illegal for a company to give negative feedback on anyone, Your recruiter should know this. And true or not, that your recruiter told you that is highly, HIGHLY unprofessional.

Could be they simply filled the position, hired someone else and cancelled upcoming interviews. They don't owe anyone any explanations. Many people would likely doubt them anyway. Better that you didn't waste your time going on an interview for a job already filled, then wait forever to never hear from them.

Don't waste your valuable energy on that irresponsible comment your recruiter made. You may want to consider reporting this recruiter's comment to their superior. What they said was inflammatory and wrong, not to mention defamation of your previous employer's character.

Oh...and maybe find another recruiter. How this one works is not in your best interest.
