
Wrongful termination
I was hired on at a company that was just suppose to be temporary After I completed the temp assignment there was a position open for a clamp driver. They let me try the position, and I was able to do what other employee's were table to do only after at least a few years driving, in a few days. My probation period was over and was drug screened and hired permanent. After a couple of months I was called into the office to go over my insurance packages with H.R. person. Afterwards I went back to work and was called in three hours later again to speak with the H.R. guy. It was then I was told that there was a rumor that I was trying to sell someone at work pot, I said it wasn't true. Then he said that there was also a rumor that I would supposedly come in from my lunch break and ask people if I smelled like pot. I told him that's also a lie. Then he mentioned some breakage I had, I told him I asked my supervisor if he needed me to drug test and he said not to worry about it cause I was new and still in training. At the time our supervisor told us and we would see for ourselves that a lot of the boxes would come damaged from the winery. He then tried to say I damaged the boxes and I said it wasn't true. I had just got hired not even a month earlier and passed my drug screen. He asked if I would have a problem testing again just to clear the air. I had just unloaded three trucks by myself, he informed me that if I would, I'd be on suspension without pay till the results came back in and if I didn't I'd just be suspended. I felt harassed, slandered, angry but I said I'd test. Then he said they'd have to drive me to the clinic, that I couldn't drive my own vehicle in my condition. (insinuating I was high or something.) While in the car I had second thoughts, here I am just doing my job and here I am slandered and envied. I told him never mind I wasn't going to test I just got hired permanently not even a month ago. I was let go.

I totally understand how you feel but as a manager myself I have to assume there's another side to your story. Regardless, once you declined to go thru with the test, that was your down fall. You can't prove your innocence without the results of the test. All else is just noise. How they treated you is your statement but all credibility went out the window when you refused to test. Sorry that you lost your position but if I were the manager I would have terminated you as well, there was no other option considering your response. Good luck to you.

It is usually written in the employment contract, that if anyone has any reason to suspect you may be "under the influence" of any substance, they may demand testing. Results usually are returned within 24 to 48 hours... you wouldn't have lost much pay. Especially in positions where driving a vehicle or operating any type of machinery, this is very standard - if you take a similar position with another company, be aware: they usually have these clauses for random or other drug-screening for insurance purposes. It's perfectly legal and the absolute norm. Stay "clean", and take any screenings the employer demands.

This is wrong on all levels. Hr is totally wrong.please get an employment lawyer.

I understand where you're coming from but you probably should have done the test just to prove them wrong. This is a crappy situation but I doubt it qualifies as wrongful termination. Best of luck to you in your search for a new job.

I agree, not doing the drug test implies they were correct with their perception, just have to live and learn

I believe, that by you choosing to not go through with your test again, gave them that open door to the rumors being positive even if you were in your right. You should have played their card and at the end you should have won with an ACE card. I am so sorry you had to endured all of this allegations. Keep strong, something else will come your way.

You should had gone through with the drug test to prove to him you were clean. You gave him a reason to feel you would test positive and yes it is demeaning and humiliating that he drove you there ( I would had made a joke out of it saying, "Well this will save me gas money, so thank you!")
You should also report him to the CEO of the company, to keep accusing someone of something is harassment, but see since you refused that test it will make him tell the CEO you had something to hide. Next time just take the drug test and when it shows you are clean it will stop them from accusing you of smoking pot, or doing any drugs.

I do understand how you feel, however I would of done the testing just to prove that I was clean. And went from there. Also I would be looking elsewhere for work while waiting for the results to come in. In that time frame you can decide whether to stay there or move on.

U should of did the test u shot yourself in the foot on this one!
I think you should have taken the second test. It might have given you grounds for a lawsuit. Maybe you have grounds without it
