
Un-payable employee......
Ok so after about a month of being unemployed because of the unethical things my last employer did to me, I finally found a job that I already had experience in and loved to do. Automotive repair. I LOVE IT. But, the love for it was almost taken away from me from my previous employer. I did not go searching for this job. Nor did I apply for the job and wait for them to make a decision. The shop in Byram, MS. emailed me and asked if I would come talk with them. So I did, and it sounded excellent. Decent pay with commission, very reasonable hours, owner was very nice and understanding. What more could I ask for, right? Wrong. After my second week, got my first pay check, decent but not what I was expecting. Next week rolls around, little bit less. This continues for the next two months. Last Friday I was on my way to work, praying things would be better, only to get 2 mins away from the shop and then I get the TEXT. NOT A PHONE CALL, A TEXT!!!! Explaining how he couldn’t pay the bills at the shop, and his own bills and still pay me. Really?!!!! You wait all week long to tell me this?!!!! You couldn’t have told me this on Monday morning?!!!!! But this isn’t even the bad part believe it or not. This owner charged customers retail price plus labor for parts that he would pull from a junk yard. These parts went into Audi, Mercedes, BMW, Volkswagen, Etc. Made me sick once I realized this. These customers are paying anywhere from $1,800- $5000 to have theirs cars fixed. And he didn’t have a business license. Found that out the last week I was there. I worked over 30 hours each week. How is it he only paid me $100? He tried to explain to me that there where a lot of customers that hadn’t paid him and that there was no money flowing into the shop. But, all the work I put into the cars and SUV’s, all the bodywork, all the brake jobs, replacing chains in gear boxes, all went right down the drain. I got paid $100 because I told him I had bills also. I was borrowing money to get to work praying things would turn around with my paychecks. So the $100 he sent was out of pitty. He didn’t want to send it to my cash app at all. So out of all the work I was almost finished with, he will finish it and get his money for it, while I’m sitting here trying to find more work and struggling even worst than before I met him.

You know. . . that is F@#% up! I just don't know what to say I'm sorry you had to endure a day of hell.

Choose a time and place that best allow you to relax your mind and devote your thoughts to reflection.

That all sounds bad. Well there is many ways you can take this. You can report him to many people. He could get into trouble with a lot of law suits his way. There is this other option. Walk away from it all. Go find something else. It will be hard. Life is not easy or fair, but that does not mean to give up. Life is also full of lessons. This happens to be one.

Is this business still in operation? If so, I'd report him if hes getting away with it.

I have consulted a lawyer to find out more information in what I am obligated to. Unfortunately I didn’t have “enough” proof for them to take the case. And because he doesn’t have a business license, which I only found out a week before all this happened, the BBB and others can’t intervene until he is official.

Ok I can be wrong but if you work with friends you feel obligated and if we jump at go without checking into more of the request we also pay the price

Too bad that you aren't where I live. We have very few mechanics and the one good one is drowning in work. You have a valuable trade. I would look into getting a business license and start advertising. No doubt that you would get plenty of work.

Anytime I get a new job, I do a little research on them. I look at their Taxes and their Employment Fluctuations to make sure I have some type of job security.

I may have answered this question already. But sure I didn't add that you need to sue your former employer at the very least in Small Claims Court for lost wages and any other expenses (not commute miles, though, but moving expenses might be okay, if you needed to move away a considerable distance from previous abode). You also might want to file complaints with EEO, National Labor Board, apply for Unemployment, etc. It might be a good idea to seek out an EMPLOYMENT LAWYER BEFORE YOU DO ANYTHING.
