Lost job...employer took my vacation time
I was recently terminated from a job with the state of Indiana. I was terminated for cause; when I asked if I would be able to cash in my remaining vacation time (about five weeks), they said that time is forfeited. Is this legal? I earned that time over the 11 years I worked there....they didn't take my pension (thank god), so if the can't take my pension, can they legally take my vacation?

File your case with the Labor Board and force them to administrative court.

Legally, they can't take your PTO. You need to fight for that! They can cash you out and pay you for all that PTO, but they can't just take it. People quit jobs or are fired all the time and aren't able to use their remaining PTO. Companies can just cash it out for you. Fight for your pay, Jimmy!

Federal and State Laws Therefore, employers can't change their vacation policies in a way that would take vacation time away from an employee who has already earned it. They also can't have so-called “use it or lose it” policies, in which employees forfeit unused vacation time after a certain date.Sep 20, 2018
