
What to do after a job was taken while on medical leave
I work in a daycare center as a teacher for one year old's. I had planters fasciitis and had to have surgery on my foot. Went on December 7, 2016. After surgery it's was still sore, so in and out of the foot doctor offices with more shots, I was off from work to heal, mind you with a doctors note. And one month went by and boss called to see if I was coming back I said yes but whenever the doctor releases me to work. Two months went by still could not work, still getting shots in foot and couldn't figure out why I was still hurting. Which I put in for disability since I had no money coming in. And boss called again. And yet I told her not sure when, but I will be back. And then they assumed I wasn't coming back, my aid took my job and hired someone else for that aid position. Now I can go back to work and I am on restrictions, I have no job to go back to but the kitchen, which is standing all the time. I can't say no because I needed a job. So I did take it. I can't believe they thought I wasn't coming back when I told them yes, and had a doctors note to be off. I have been with this company for 7 years and they treated me like this. I feel so low. I really did not want to go back. I just wanted to quit. But with the medical bills I needed a job. So mad!

I'm sorry about this but have you spoken with HR regarding this since this is a medical reason? You should have some type of medical leave protection in place to prevent you from losing your job. Have you checked to see if this new hire is someone to fill in while you're out or have they permanently filled this position?
It's a bit hard to determine any course of action when it seems like you didn't want to be there in the first place since you wanted to quit. However, due to medical bills you need the job, but if you have exhausted any medical leave time frame based on the company's medical leave, you may have reached a point where your employer can terminate you regardless. However, check with HR if you believe otherwise, but if not then just move on being that you had planned on quitting. Maybe the company did you a favor by this end result. Good luck!

That's horrible Sharon! Is there any you can speak to HR to get the position you previously has back?
Sorry to hear that depends on what state you live in I know California they don't have to give you your job back after three months of medical leave. check out what your state laws are good luck
