
how long after termination should you wait to file lawsuit if you believe it was wrongful termination
I was recently terminated from job after 3+ years...had 3 write ups in 2 week period and 2 of those not even my fault...I feel new management just wanted me out of the way as I saw things going on that were not company policy...what is the wait time as I do not this to effect possible new job

Brenda trust me I know how you feel. I worked for a company 7 years never got in trouble ( wrote up or suspended)I left went somewhere else doing the same thing was there 3 years got suspended 3 times wrote up 5 times. Then they fired me. I know coming from a background of management once they have their eye on getting rid of you it's over you will be gone. I am in Texas and we are one of those states that they can fire you for the way you look that day. (SO SAD) they don't look at how hard you work or what you do. They want the people that are useless and they pay to sit around. I'm sorry that you got fired. Goes to show if you can't play the game as a useless you won't have a job as a good worker.

It is so hard to prove wrongful termination, especially if you are in an At Will Employment state, or if the employer is a bigger company with corporate lawyers and deep pockets. My advise, and it may be too late is to take advantage of the termination by immediately asking the reason for termination, and while they are still feeling a bit guilty get them to write you a letter of recommendation. The longer you wait, the less likely they will feel compelled to help you.

I think it depends on your state labor law, the reason behind the write up. Contact an attorney for free advice. Many offer about 30 min to 60 min. They will then tell you if you have a case or not. Make sure you have all your paperwork, evidence with you. Treat it like an interview. First impression is important. Good luck
